BUILDING CONCERN on RFE
My RFE is fot my wife's and joint sponsor's W2 and Income Tax returns. I forwarded the information to my attorney and she called me back saying that I do not need to send on the joint sponsor's tax documents because my wife and I filed together and we make very good monies. My concern is not sending my joint sponsor's documents when I know they are requesting it. I assume my attorney is the expertise here, but I want to know if anyone had shares such experience.

I received a request just the same....RFE for initial evidence. Since we filed in 2021, I resubmitted the documentation with updated information i.e recent tax information. Once your income is enough, refill the documentation with the updated information.

If your wife's income is more than the requirements, you do not need a joint sponsor but if it's less than that, you do need a joint sponsor. It is also based on the household number. In anyway, it's always good to add extra.
