Birth certificate for I-485 doesn’t include my name: anyone dealt with this
Hi everyone,
I’m preparing to file my I-485 and just realized my birth certificate only lists my parents’ names and my date of birth; my name isn’t on it. I’m 40 now and my local county says the maximum time to add a name to a birth record was 15 years, so updating it isn’t possible anymore.
- Has anyone here faced something similar?
- Did USCIS accept it as is?
- Did you submit any affidavits or secondary evidence?
- Did it lead to an RFE or was it approved without issues?
Would really appreciate hearing what worked for others. Trying to avoid another RFE if possible. 🙏##

you may need your medical records from the hospital you were born at .
I hope you have a lawyer to help you throughout this process.. 🙏

You can swear an Affidavit for DOB and declare the incomplete document as missing. Simple

@ShirdiParthi Prema , for me I was not having birth certificate, I have filed Form-10 which is NOC and with affidavits, suggested by the attorney. yes USICS accepted the documents.

DS-10 is a passport form? will this be accepted for I-485 application? @Pavan Narravula

@ShirdiParthi Prema , it’s not DS-10 , its Form-10 for Non availability of birth certificate for me.

@Pavan Narravula I see. it won’t work in my case because my birth was registered but my name was not. not sure if I should just send in the affidavits

@ShirdiParthi Prema Send them as much proof as possible now. If you get a RFE, it will take much longer. Get affidavits from parents,, send them proof that you are being told your name can not be added.
