Background Check for Job
hello everyone, I got an offer for a job that starts June 3rd and they just sent me an email regarding them completing a background check. I already have a social from previous filing. Wouid the background check also consist of them running to see if I am verified to work ? I am still waiting for my EAD card and it is currently at 167 days of wait. I already expedited with congressman but waiting for USCIS reply. but I am hopeful to get the card before the start of the job. Should I accept the offer letter so they can do the background check? Has anyone gone through a similar issue ? Please help :(

@Mrkvica M. so should I decline to do the background check? what risk am I imposing for them doing the background check anyway ? and I have heard of instances where it shows they are eligible to work but it they haven’t gotten their EAD yet

background check is to see if you have any criminal records. You can totally do it but I suggest being at front with the job. Explain your situation and that you are legally allowed to work and just waiting on your physical EAD and you will provide that on your first day of work.

@lalapgush . you should present the receipt and your expired EAD to the employer when they ask. Right now, they don’t even need your EAD to do your background check. They just need your social, DOB, DL I think. Since you’re already on 167 days of wait, I’m sure you will receive your new EAD soon. I’d say accept the offer letter and let them do the background check. It’s hard to get jobs these days so don’t let this opportunity slip away. As a matter of fact, conducting a background check doesn’t have anything to do with your eligibility to work. They are 2 different processes. Verifying your eligibility to work comes at a later stage in the job verification process when you want to fill the form I-9. Some companies even do it on the first day the person starts the job using E-verify.

@lalapgush yeah, you'll need that EAD first day on the job for the I-9. Maybe talk to them and hopefully they'll hold the position until the card comes but let them do the background check. Be upfront with them so they don't feel like you're being deceptive
