Asylum Application and EAD
I had applied for Asylum on 8th of June 2023. USCIS sent me a receipt notice on 9th of June 2023. Then I went to ASC for biometrics on 27th of June 2023.
Now there are lots of rumours about applying for EAD just 3 months after receipt notice. According USCIS website, an asylum seeker whose case in pending status is eligible to apply for EAD 5 months after receipt notice.
1. Can I apply for EAD 3 months after my receipt notice or should I wait for the ending of 150 days?? #asylum #EAD #workpermit
2. There is an option for premium processing request for EAD application. Should I take that? or in either way, I-765 (EAD) form will be processed within 30 days since I am an asylum seeker in pending..

I applied for EAD 5 months after submitting my asylum application, as per USCIS rules. I got my intial EAD approved and issued in 30 days, with ssn card. I didn’t opt for premium processing.

@Alexander Makhmudov thank you so much for your reply. did you have an attorney or did you apply for EAD on your own? is that a simple or complex application?

no problem! it was an easy process - you can do it online. It’s just a simple form to fill out and submit. No need any extra documents attached. And they should have your biometrics already from the asylum case. They are obliged to process your initial EAD within 30 days (if it’s based on c8). I didn’t have an attorney for this process.

@Alexander Makhmudov may I ask you something? I'm the applicant and my wife is my dependent in my asylum case. I will apply for I-765 work permit. Can my wife apply for I-765 work permit, too?
