Asylum and concerned if status could be changed
Hello Everyone,
My spouse change his status from F1 to asylum back in 2017. So far he has been working with asylum EAD but the case has not moved yet!! I have my GC from EB3-skilled.
Our concern is, is it possible to file for adjustment of status? Can he withdraw his asylum? will there be any complication.
please let me know if you have gone through same situation. Any suggestion will be greatly appreciated.

If he maintained his legal status throughout his stay here, yes he can adjust his green card through your green card but if he was illegal even for 2 months, you need to be a citizen first before filling for him. He needs to keep his asylum application until he has the green card in his hand

if he doesn’t have a legal status beside asylum then no. you cant give petition for him with your Gc because he doesn’t have a legal status and asylum doesn’t qualify as a status for adjustment …also GC petition are not imesiate and depends o nthe country you can wait for awhile….
