Approved I-360, Denied I-485, Rejected I-290b
Approved I-360 in 2022
USCIS denied my I-485 once so I resubmitted
second I-485 was denied because I didn’t appear for an interview.
However, I never received any mail about an interview, nor does my case status say anything about an interview. It literally went from “We received your response to the I-485 (my medical exam)” to “Your case was denied.”
I filed Form I-290B, Notice of Appeal or Motion. The first time it was rejected because I didn’t submit the fee. I refiled with a screenshot from USCIS and a letter explaining that VAWA-based cases have a $0 filing fee. The USCIS website (G-1055 fee schedule) states there is no fee for VAWA based cases. No fee for the I-360 or an I-290B appealing an I-360, and no fee for an I-485 based on a filed/approved I-360 or an I-290B appealing an I-485 based on an approved I-360.
They rejected I-290b a second time and returned everything, including a letter stating:
“We are returning your Form I-290B, Notice of Appeal of Motion, to you because you did not submit the $800 fee.
U.S. Citizenship and Immigration Services (USCIS) has established an expedited process for reviewing and correcting decisions resulting from certain administrative errors made by the agency. This process enables you to request an expedited review of your case and correction of the decision where USCIS data entry and/or an administrative error resulted in a denial of your petition or application. Once USCIS has received an expedited review request from you, the agency will make every effort to take action on the request within 5 business days.”
What is this? I can’t find any information about this “expedited process.” I didn’t request it, and nothing on the form mentions it. There’s no indication anywhere that a fee applies to VAWA-related forms.
Can anyone explain what’s going on here?
I’ll call USCIS in the morning, but I don’t expect much, they never seem to know anything.
This is so frustrating. Im so tired of this, so I packed almost all my stuff and will move soon to another country, but just curious maybe someone knows what is going on

sorry to hear this. I’m in a similar situation as you but I filled I 290 b with $800 fee and my case was reopened about 100 day later but nothing since it’s been over a month now. my advice to you is to resubmit along with the $800 fee. don’t argue with them just do what they asked you to do.

i am sorry to hear that, what i understand is when you file vawa or i-360 there is no fee that you will pay but when you apply for i-485 you have to pay even it is connected with your cawa case

You should file a fee waiver. If you have a lawyer, he would tell you to pay the fee then USCIS will return the money if you qualify for fee waiver. Note : You should hire a lawyer even if your case is very strong.

@Ms.Happy Sabbath :) there is no fee for 485 if you filing as a person seeking adjustment of status as a Vawa petitioner. I just telling you what USCIS website said! I didn't file fee for my 485 and they accept petition no questions ask!

@Ibe trust God wait? what? so this is happening to another ppl too? they denied your 485 because "you didn't appear to interview". but they didn't send you any notice! and there is wasn't any update online on your case too?

@Ms.Happy Sabbath :) I don't know where. because I didn't receive any information about interview. I learned about interview after I received my denial notice. this is where I learn first time about interview.

it’s USCIS error. but I for some reason get punished for some one mistake.

@Jerry Moyes for what I herd, if you qualify for fee waiver. but you still submit your form with the fee. they will cash a check regardless of you have fee exemption or fee waiver.
I know, I could just fill the fee and just forget about. but they literally messed up my case. they most likely will denie my 290b so I will lose 800$. and money isn’t free. I just trying to do everything right how they want me to do

@blessed & favored I didn’t requested any expedite service. I just file a I-290b with covered letter, brief and evidence!

@D Y yes a lot of people getting denied nowadays. my case was denied because i didn’t send them my untranslated birth certificate and now that i sent it they taking forever to make a decision

@D Y i too a Vawa petitioner my vawa application is free no question there but my I-485 and I-765 i need to pay for it. so idk where did you get the info of it but i think everyone needs to pay for I-485

@D Y the only thing I can say is, with all that's going on, there's a lot of mistakes being made at uscis. I received a notification in April that a notice was returned undeliverable, which was weird because we got every other piece of mail before. Took many calls, requests for copy of mail, and the entire time I was told they dont see where an interview was scheduled or what mail was sent. I continued to pursue, and eventually my lawyer called for an infopass. I went to the field office and lo and behold, a mail had been sent in March for an interview but was sent in my name to my lawyer's address so of course it was returned. They acknowledged their error so now I wait for another interview date. All that to say, maybe when you filed the form after the denial they didnt associate it with your approved vawa, which is why theyre asking you to pay. I'd say book an infopass appointment and go see someone in person.

I get my info on the official USCIS website! look for yourself. paper files I-485 is $0 for Vawa. it's just a fact's.
if you in immigration court and you getting deported you can file 485 with a court for $1500. this is only time when you file with a fee. but this is unique situation. so if you file with Nebraska service center you pay zero.
and 765 is free too for Wava. but if I remember correctly you still have to pay for work permit if you file for 485 base on Wava. so technically you pay only for 765.

@Kerry S I don't think they don't know that I go under Vawa. I send second time I-290b with covered letter that said multiple time about 0$ fee for Vawa. and I did include screen shot from the website! you have to be blind to not see it. I even highlighted place where said about Vawa and $0 fee. I include copy of approved I-360
I tend to think this is on intentionally. they keep messing people's cases so they get discourage and leave. at least this is what I planing to do. getting my stuff packed and will leave. Tired of this bs

@D Y they are giving you an expidited REQUEST REVIEW even though you didnt ask because its an ADMINISTRATIVE ERROR on their part.
I WOULD SUGGEST YOU
1. be focused you've gotten this far. You will get the green card.
2. Just pay the $800 fee at their request, if you do not have a lawyer. If you do have a lawyer and paid him/her legal fees to represent you then MAYBE you can rebut USCIS.
If you are alone there is very slim chances of things changing.
you are correct about $0 fees for VAWA but also remember whose administration we are under.
3. Book info pass to see someone, make sure evidences and arguments are very strong at this meeting.
