Approved I-360. Denial I-485
my 485 was denied because allegedly I didn't show up on interview. I didn't receive any mail about scheduled interview. Neither my case online says any information about interview. I did called to USCIS after I received denial notice. They told me they don't see any interview was ever scheduled. and they told me, immigration officer will call me. it's been a month and no calls. I did fille 290b. but no receipt yet! I understand it’s pretty much USCIS error, but I’m wondering if I get pulled over and they for sure will send me to detention? and deport?
does anyone have any suggestion what should I do?
I plan to leave US next month and apply through counselor process. does anyone knows how this works? and what a success rate? I also have approved work permits and advanced parole based on 485. if they approve 290b, can I enter US with advance parole, if I leave now?
or this 485 is done pretty much? and I should start all over again and better outside of US?

ask your lawyer what you should do but if I may suggest, you are almost there and you did a good thing by filing 290b. they would surely reopen it so I’ll suggest you wait.

@D Y do not leave the country for any reason, wait until USCIS rectifies their error and conduct the interview if you leave there’s no guarantee they’ll let you back in. You sound like your head is spinning, take a deep breathe and take it slow. You filed 290B, if it was their error they will approve the 290B and schedule your interview. Try and relax don’t rush into anything otherwise you might end up screwing yourself more. Best of luck.

In my case, Interview notice was sent to my address but wasn’t updated on case status. This has also been the case with others I know. So If I were in your shoes, I would get an attorney and I wouldn’t leave the country under present circumstances. Goodluck 🙌🏾🙌🏾

@victoria B lawyer said wait. and not sure about consular proces. He said you have lower chance to get green card while you outside of the US.
But I don't want to take a risk and to be picked up and deported. or just spent months in detention center. right this second I’m with out status if I get pulled over. I screwed. unfortunately I rent and don’t have some one to help me while in detention. I might lose everything in my apartment due to not able to paying rent
I have really complicated situation with my country of origin. if I lose my passport I only can get passport if I go back. but my country of origin will not allow me to leave! and I know ppl in the similar situation already being deported from US to my country
I have opportunity to get residency in Argentina and passport in two years. So I just compile my plan. is it worth to take a risk here

@r or no eligibility notice. I dot’t know what is eligibility notice. my ex spouse American citizen so I don’t have to wait. I submitted all together with evidence. there was not any request of evidence. I’ve waited for 9 or 10 months and got approved and received work permit for two years. that’s it

@blessed & favored you 101% right. but I don’t want to be picked up and spent months in detention. I have really tricky situation. I don't want to go in to many details, but if I will be deported to my country of origin I have really high risk to die. so I would rather take L then risk my life! I have opportunity to get residence in Argentina and citizenship in two years.
and even get detain is lethal for me. I might lose everything
