The above petition has been approved. i think you just have to let them know if you want to do AOS or getting visa for your spouse from embassy. so they can proceed further.

my spouse is outside of the US so from my understanding I can't do adjustment of status. Its consular processing right I would file to file i485 is that how I would let them know? does he file i485 or do I

I think you select both in your application i-130 (AOS or consular ) or you left blank these sections now you have to file the form i-824

This has nothing to do with the i485. When you filled the i130, you didn’t indicate whether or not it’s consular processing. Your i130 is approved, you just need to tell them to send it to the State Department.

yes fill out the I-824 to let them know if it’s for consular processing or not. Keep in mind I-824 can take a long time!

If you have any reason to expedite after you file the I-824 you better! I hear it can take up to a year

congrats 🍾🎈🎊 I guess it a mistake from them or you they is no problem,just called them that your spouse is not in the state let them send your documents to nvc please call them and explain more to them before it will be late ,your i 130 has approved
