applying for expedite: does it slow down your application? Recent application was denied.
Hi everyone, my immigration this year has taken a toll on me. I feel like I am living in a bad movie. My dad died in June and I got an emergency advanced parole, my uncle qdied in July and I did not return for that. My mother found out at the end of August that she has cancer in her thoracic spine and in her sternum bone. Canadian medical sucks for waiting and she has not even seen an oncologist yet. She is having a full bone scan tomorrow and had a full body and brain CT scan. They are looking for the primary source as her doctor does not think it originated in the bone and has spread from somewhere else. I requested a expedite of my parole with a very short letter from her doctor. I also wrote that she is getting more tests done. I was denied as I did not meet the criteria. I guess I need to wait until she has surgery scheduled or chemo. My immigration lawyer told me when I wanted to go back for my uncle that applying for expedited travel can slow your application as they “pull” your file. I think he was just trying to stop me from asking for my uncles funeral. Sorry I am super long winded on this. Has anyone ever heard of this? Applying to expedite or applying for two emergencies/expidite can affect the duration or outcome of an application to adjust status? I think he was just annoyed dealing with me and all of this. But he was very supportive of the one for my mother. I will try again when I have more info about her prognosis. I am scared 😱 that all of this will prolong or negatively impact my case.

Dear Kingsley , I have a 93 years mom in my home country, so I know exactly what u r feeling now. MY long waiting was 2 years 7 months now . I had applied 3 times emergency advance paroles to return and see her when she was very bad and critical in the past 930 days ( each time abt a month stay ) . USCIS never approved me any normal I131 for travel like other appliants and rejected my expedite both on I485 & I131 . I think you should put yr mom’s health in first priority and only concern , go get the one time emgergency i131 to see her and give her your care and support . At least make yourself no regret as her beloved daughter . Majy people here u could see wait from 90 days -1200 days , sad to say that it is just our fate , not because what we did during application . The waiting here is painful enough , don’t let it further kill yr normal life .

you can easily go get it by yrself , without the lawyer . call the hotline , ask for Emergency Advance parole, they will give you an appointment date by a return call of the other dept . 1. make sure u have a very detailed letter from yr mom ‘s dr to explains her very critical status , and yr letter explain she need yr support and care . 2. bring yr birth certificate . 3. the plane reservation , must leave within 14 days and have ye return date too ( they don’t consider over 14 days departure is Emergency case!! Beware of this ! )

this story is so heart wrenching. there was another woman that tried to expedite her 131 for her wedding and she was successful then a few days later she got her 485 approved. the 131s and 485s are approved on different tracks. I do not think pulling a 131 impacts your 485 AT ALL since my 131 was approved at a service center and THEN after that my 130/485 went to a field office for review there. I say go for it. fuck USCIS. if they don’t allow you to visit your mom with THIS going on then it’s proof they are soulless assholes. wishing you the very best @Kingsley B

@w s 🇨🇦🇺🇸 I agree with u , the stress and pain we suffered for all the waiting , on top of the separation with families , difficulties to work and fly like a normal person, especially when our parents or kids are in this kind of critical situation, it is so hurtful . The grand pa of my kids was in terminal cancer , left only weeks , also with the unstable health of my 93 years old mom . I used these 2 medical letter for applying expedite . REJECTED ! Then few days later my ex father in Law passed away and I could not able to say last goodbye to him . Then I had to go USCIS for “emergency parole” to attend his funeral and visit my 93 years old mom . At that time , I told myself if they reject me again , I just gave up the Green Card application , as too bloodless , no human right at all . I had paid 2 years big tax for IRS , why I am like a prisoner or a illegal immigrants , lost all my freedom as a normal person . This is why whenever I saw our friends here have similar case , I will write long answer to them . wish my past experience could help them and clam them down .

EXPEDITE I131 can takes you weeks or month with no reply or a denial . But emergency advance parole ( one time visa ) will approve much easily on the same day with all the supporting documents .

this sounds so overwhelming! I don't have any advice for immigration, but please make sure you get the appropriate psychological support before all this breaks you. It all sounds very hard

sorry to hear all of that. there is expediting and then there is an emergency AP, if you already have AP pending and you ask for an emergency by calling USCIS they will schedule an interview in the local field office within 7 working days I believe if approved they will give you the AP on the spot, bring all your medical report and it needs to state that this is a life or death situation. Expidate takes a bit longer to review but is easier to get approval (I think you can submit it online)
