AOS denied. what to do next?
Hi Everyone. I got my case denied because I didn’t provide evidence of my lawful status. I have talked to 2 different lawyers: one says I will get a deportation order if I don’t send a motion to reopen after 30 days. the other says I won’t get a deportation order and I can build a stronger case and re file. who do I believe?
I have asylum pending since 2017 (I applied way before my duration of Stay ended) so i never accrued unlawful presence. and I also have TPS approved.
Also. my I-130 is approved. #AOS #I485 #DenialNotice

if your spouse is not a us citizen u can’t adjust your status base on tps or asylum, I’ve hear they’re trying to work on the rules to see if they can allow green card holder spouse to adjust status base on tps but I’m not sure if that’s a law yet. I was in the same situation I had to wait until my spouse became a citizen to apply, but I’m not a lawyer I don’t know much

@R.SR, let me talk to you from experience, pls prevent yourself from getting deportation order, once you get that, it takes years to remove your name from it, I have been in it since 2020, my advice is you either refile immediately or you re-open the case, just make sure they are working on something on your behalf.

thank you for all the responses. my only concern is: do I have to refile before the 30 day deadline? if not, does that trigger a deportation order even though I have tps?

Please answer this questions and I will point you to where you can get help and possibly get your case reviewed. Did you file on the basis of marriage? If yes is your spouse a green card holder or citizen. Is was your tps valid when you filed or did you need to renew?

Also what exactly did your denial message say? If it’s just that you don’t have status then maybe you can send them evidence of your tps which is a legal status.
