Anyone got asked for 601 waiver during AOS interview?
Basically on the I-485 form, we have some yes on misinterpretation questions. Husband came on F1 with the intention to file asylum. Did not go to school, did file asylum.
Removal proceedings is dismissed by court. We have interview tomorrow.
Will we be asked for 601 waiver?

i came US (EWI) andI was file asylum 2016.
my wife applied for me I-130 & I-485 on 2021.
my asylum was dismissed by court 2022.
now my i-130 & I-485 still showing we received your case. no interview date yet.
I don’t know what’s going on. do you have any suggestions for me.

at the interview almost four years ago, I found myself inadmissible
I was told to file i601 but got denied for lack of evidence 3 times
anyway, my husband and I kept fighting
until they approved me last month
but I'm still waiting for my green card.

i think it depends on whether the person is TPS or DACA whether you have to do the 601 when EWI but did advanced parole and entered legally. all you can do is attend the interview and see what heppens. make sure to tell us.

Update: didn’t ask for 601. husband didn’t entered illegally but we were worried we will be asked for misinterpretation. Officer didn’t ask to do 601 but she also didn’t approve us yet. She said our approved I-130 was somehow sent to State department so she needs to request it back. sigh Lawyer said she may still ask for 601 who knows and to just wait patiently.

@ unknown but I’m confused the same officers will be made decision ? or the office where we send it ? or you know that works I seen people waiting over 2 years now

unknown@ I mean they send me noid and ask 601 will go back same officers ? because my lawyer said have to send another office and wait for receipt I’m just confused

@s Singh according to my lawyer it goes to another office. the other office makes decision on the waiver
