Anyone else with VAWA pending since 2020–2021? Seeing a worrying trend
Trying to analyze what might be missing in some of these pending cases from 2020–2021, especially since I’ve been seeing a concerning trend of denials lately. I’m wondering if there’s something common between the cases lack of certain evidence, criminal history issues, overseas travel, or overstays, filling place, length of the marriage, or something else. In my situation, I was living with my ex-husband’s family, so I didn’t have a lease in my name and I think it’s bad. It was also during COVID and we didn’t travel much together to give USCIS a lot of pictures or affidavits. However, I do have joint bank statements and years of joint tax filings. As far as I know, USCIS hasn’t disputed the abuse part of my case they issued an RFE for good faith marriage, but they didn’t question shared residence. My case has been pending since August 2021. I don’t have any criminal history, I’ve paid my taxes, and the only issue on my record is that I overstayed my visa. I originally came to the U.S. on a J-1, and I’m from a former Soviet Union country. No kids, 3 years of marriage, filed from NYC. I know discussing this won’t necessarily change the outcome of our cases, but it might help us prepare. Some people on Discord, mentioned possibly filing a lawsuit against USCIS. Maybe we can gather experiences, compare timelines and RFEs, and see what patterns we can find.

@dookili Fraud is fraud. I’m not against them going after it they’re doing what they have to do if they fighting against it. But what’s frustrating is the way the cases are being handled. How is it that some cases move in a year while others are left sitting for 4 or 5 years? What exactly determines that weaker evidence, the office the case was filed through, or even the country someone is from? I know asking that won’t change the outcome of my case. I’m just trying to understand how the system actually works and how they decide which cases move forward and which ones get stuck waiting for years, based on what I have I was told I’ve been told I had a solid case but years later it was forwarded to be handled by FDNS, what exactly triggered it

@tired from waitingg all the old cases going or will be checked by FDNS, my old lawyer and a new one have confirmed it. FDNS is a part of vawa process from December 2025

@tired from waitingg did you apply from east coast? and have you add objective evidences? how long was your marriage? I don’t get it why it’s taking so long for them

@C D no i applied from west coast. i have all the evidence marriage was almost 2 years old when I applied vawa but i m still married did not want to divorce cuz did not wsnt to lost my combo card hbu?

@tired from waitingg then you should be good. I’ve applied from nyc, I think I have enough of objective evidences to be approved but again, maybe not. missing some points in terms of no lease, no insurances. married for 3 years, divorced
