Anyone else with VAWA pending since 2020–2021? Seeing a worrying trend
Trying to analyze what might be missing in some of these pending cases from 2020–2021, especially since I’ve been seeing a concerning trend of denials lately. I’m wondering if there’s something common between the cases lack of certain evidence, criminal history issues, overseas travel, or overstays, filling place, length of the marriage, or something else. In my situation, I was living with my ex-husband’s family, so I didn’t have a lease in my name and I think it’s bad. It was also during COVID and we didn’t travel much together to give USCIS a lot of pictures or affidavits. However, I do have joint bank statements and years of joint tax filings. As far as I know, USCIS hasn’t disputed the abuse part of my case they issued an RFE for good faith marriage, but they didn’t question shared residence. My case has been pending since August 2021. I don’t have any criminal history, I’ve paid my taxes, and the only issue on my record is that I overstayed my visa. I originally came to the U.S. on a J-1, and I’m from a former Soviet Union country. No kids, 3 years of marriage, filed from NYC. I know discussing this won’t necessarily change the outcome of our cases, but it might help us prepare. Some people on Discord, mentioned possibly filing a lawsuit against USCIS. Maybe we can gather experiences, compare timelines and RFEs, and see what patterns we can find.
