advice please
anyone has ever experienced this before. so in rec 2023 I submitted my complete AOS PACKAGE (i130&i485) few months later I switched to vawa(I1360) for obvious reasons. I sent a letter of abeyance for i485 to NBC, November of 2024 they approved my AOS (i130&i485) and the December I received a prime facia for my vawa. my vawa is still pending, what does someone do in this case please, I got a 2 years conditional GC. I also only filed i1360 . #vawa #marriagebase

I'd like to know about your case. Did you have an interview? I submitted the VAWA myself, then my husband sent my complete package. I'm waiting for an interview, and so far I haven't received my EAD. I received my first prima facie through VAWA, but both cases were stuck on biometrics.

@Gaby Rodriguez no there wasn’t an interview , it was waived, if I had an interview I would have gone and told them I filed vawa

@It Will Work for me Your case is weird. I think some agent said: send her her residence. Waiting for Vawa is too time-consuming, and at least you don't deserve to struggle through the process until Vawa is over. At least two years of peace. Your husband won't sign the conditions, so they'll continue with Vawa. That's how I see it.

@it will work for me: I suggest that you join the reserve army if you are still qualified in age. One year after , you will become a citizen. all the best

@It Will Work for me I have heard of it happening before. Because if you claim violence from your spouse and filed Vawa, then why are you still getting an immigration benefit from said spouse. Consult a very good lawyer, who will advise on the action to take.

You have to consult a lawyer to notify USCIS that you get the conditional green card in error. since you filed I 360, it appears the I 130 was no longer the accompanying petition for your AOS. since your VAWA hasn't been approved, it appears they gave you the green card in error. It will be good to inform USCIS about the situation or else it might be a critical issue down the road.

@Dream Daddy it’s a very unfortunate situation because I’m currently not in financial position to get a lawyer on it! and wasn’t sure what step to take so I didn’t reach out. I got approved Nov 2024 have not used the card or anything .

@It Will Work for me Look for lawyers that give free consultation but like @Dream Daddy rightly said, your conditional was granted in error and if you do not act quickly to correct that error then you might face a lot of problems down the road.
