90 Days Rule for AOS
hi community, my parents are here in US on tourist visa. I am a US citizen and I heard that I can submit both I-130 and 485 AOS forms for my parents while they are here. I wonder if I can submit these forms right away or do I have to wait for at least 90 days from the date they entered the country before I can apply?? #IR5 #IR-5 #parents #AOS

wait for at lease 6 months to do so because when you go to the interview the officer will tell you that it was plan so be smart about it over staying your visa if forgiven at USCIS

it doesnt apply to you. thats not marriage AOS. thats for parents. you can do it even nect day after they arrival.

we did it ! we left it 30 days then filed I30,I485, I765 and I131 all together. we’ve got our I765 and I131 approved. still waiting for the rest but we’ve been advised our interviews are waived too. no need to wait for parents of a US citizen.

thanks @Lynda Kirk for your response. may I ask which field office or center is reviewing your cases? i wonder if they are waiving all the interviews in this category or if that depends on the center

Maxy j we applied 01/09/2022(so one year today!) all our paperwork is at NBC. Our field office is Minneapolis. Apparently they waived our interview in July but we didn’t know until I called in September to ask about our expedite of our I765. they told us then. we had our biometrics in April. I expedited both the I131 and the I765 in June, got the I131 in June approved and the I 765 in October. good luck it’s all a matter of patience.
