90 Day rule
can someone explain this and how it affects US citizens filing for spouse?

lots of info on google. am overstay is forgiven for USC spouses but if you’re in some sort of situation I’d connect with a lawyer.

its Jus a Period they set that determines if You and Your Spause have known each other for sometime, Dated, Or done courtship. so 90 days or 3months is a Good period of time to determine that.

I think the 90 days has to do with whether or not you came with the intention to overstay your visa ..

@DL S As I understand the 90 rule. Someone with a non immigrant visa should not have the intent to come to US to get married and stay. If you get married in the first 90 days of your entry you can be hit with a misrepresentation charge when you apply and would then have to get a waiver to return to the home country to get their visa adjudicated. Check Jim Hacking on YouTube he has videos on this very matter. He also has a YouTube call in show for you to ask your questions for free. Last thing you want to do is to complicate an otherwise simple case. Good luck hope this helps.

@My P Thank you. I am okay. A Friend of mine got married in December and left the US. He is going back on an ESTA to see her and thinks he could adjust his status as his wife has filed the i-130 in January. Any advice I can give him would be great as I don’t want him to get into trouble now he’s finally met his wife.
