I'd get a real lawyer and ask all your questions at this point

@clear Meeks it can be appeal but I would say talk to a lawyer because it tells the reason it was denied

@kk h its my case i went to my interview a year ago still no outcome now im just lost and wondering what’s gonna happen to me

@clear Meeks did you say your case get denied or it’s still pending? bcz if it doesn’t get denied you can appeal it and not because you see the 33 days on it typically means you going home I got denied with my first and I didn’t go home they made a decision but I divorced and remarried and now am going for interview

@kk h ok I haven’t received any denial I went to the two weeks before I gave birth I didn’t bring the birth paper the officer told me he need to see my name listed as the parent I got Rfe the same date 7 days later I sent the birth paper I haven’t received an outcome since then

@kk h but if they don’t make a decision by this month I would be eligible for a ten year greencard if I get approved which would be better for me sigh I just pray we get an approval soon I really wanna go home I’m so tired and overwhelmed

@clear Meeks well that’s great hopefully they wait until your anniversary to approve you and congratulations on your baby…no worries you will get it because you responded on time too that’s a big deal

@Sheero Laura I was not denied I came here on a visiting visa I ended up overstaying my visa and got married in 2024 I have done my interview and everything after the interview the officer requested Rfe for my child birth paper I gave birth two weeks before my interview I didn’t have the birth paper at the time 7 days after I responded to Rfe I have not received an outcome since then that was January 2025 I did my interview been waiting for an outcome for the past 1 year so I was just asking if I would have to go back home if I’m denied

A GC denial does not automatically trigger removal proceedings and off course is case specific. You may be able to file a motion to reconsider or reope the case or in most cases depending on the reason for the denial you may be able to refile. If are not in current valid status a denial raises the likelihood of receiving and NTA which puts you in temoval proceedings.
