601A waiver
so everyone who has a 601A waiver pending or approval has to travel back to their country for interview?? also what countries are you all from if you don’t mind me asking…. I am nervous about going back for the interview… Like are you guaranteed to return or what? #601A waiver

That's right, i601A is to waive illegal presence when traveling for interview.

if your spouse is a us citizen there is a waiver to prevent you from going back to your country
ask your lawyer about it.

@in the Jesus name amen @lovely roses The waiver doesn't eliminate you from going to back to your country, the waiver prevents the 10 year ban from kicking in.

@lovely roses FYI Biden administration announced last week a new policy in which spouses would no longer need i-601A waiver and would be able to adjust from the US.
I'm not sure if it covers parents petition, You might want to do more research. The policy will go into effect later this summer.

Yes, I applied for the waiver and was approved but changed routes later when a new door opened

@William u I read it and don’t think it applies to my case….. My mom who petitioned for me was a greencard holder and past away during the process.

You have not been through because as a refugee don't don't back to your country for interviews. Refugees are an exception.

@MR R We just sent my waiver in & was told by my lawyer that I will have to go back to my country for the interview.

@William u do you know what would be the process to transfer an approval I60A to the new parole in place.. my brother just got approved today but we are scare from him to go back to our home country.

@Sai mai There is no need to transfer i-601A as it will be a new process and new fees all over again. The only application which will be valid will be your i-130.
If your brother has tattoos, if he drinks or was a drinker, DUI , smokes marijuana now or in the past, certain criminal record then I would highly recommend doing PIP. If he has nothing of what I mention doing CP should be fine.
Do know, the fees for i-485 went up this year, the fee for PIP(i-131) is unknown at the moment.
If you take PIP route, make sure to put a hold on your CP and continue to maintain communication with NVC/embassy once a year as a backup in case PIP does not work.
Also, take into account that your i-601A was approved which was the longest waiting period for his immigration journey, he is almost done. Doing PIP might take a long time as the parole would have to approved first before submitting i-485.
