485-J
My employer wants to withdraw my I-140. It has passed 180 days since I-140 got approved with 485 pending. Now my lawyer suggests I need to find a new employer and file 485-J immediately. Job market is not that great and it's hard to find new employer in the industry I work in. If I find someone they are not ready to sponsor (file 485-J). How and where can I find a new employer immediately ? Anyone in same boat or any suggestions ? Note- I have worked with the same employer for 3 years. And recently I am out of project because of layoffs.

@Alam Mia, If an employer withdraws an I-140 petition after it has been approved for at least 180 days, the beneficiary can still use the approved I-140 to find a new job offer.

@Z K I work for an IT CONSULTANCY. According to lawyer they can withdraw since I’m not in a project currently.

hi, i am not sure if they can do anything, for what i understood from my lawyer, you need to submit the I-485J with the new company, but i don’t they can do by itself, but i am not sure.. i suggest try to find a new employer and when you have it submit the form, what is your PD?

why are they attempting to withdraw it? afaik they are not obliged to withdraw it if they are laying you off. sounds like a horrible employer. since it’s been 180 days, you should be ok as long as you find a new employer. i485j is not a complicated process (relatively speaking). your previous employer’s withdrawal attempts shouldn’t affect anything then.

@m t some employers do with draw it to be cruel but some also do so because it impacts filing other petition in terms of ability to pay. If not withdrawn his/her I-140 will be reflected as an employee that they are telling the government they will pay. If the employer finances aren't great could impact their ability to get other petitions approved so some employers with draw those I-140 for which they have no intentions to pay or offer a job to support their GC.
