yes you definitely can, remember your lawyer’s livelihood isn’t affected one way or another, you should do what’s best for you, you and your lawyer should have received a copy of the cancellation from the IC. then you can schedule the infopass or send the letter to USCIS asking them to adjudicate your i-485 since the IJ has sent it back to them.

it should be based on the visa you are adjusting through that is if vawa look at the USCIS website to see where vawa based i-485 are being sent to, this will ensure you don’t send it to the wrong office then it gets lost or they reject it. Better yet let your lawyer know they need to request an electronic copy of the cancellation from the IC since you haven’t received a copy then let them know you do not wish to wait, they need to proceed and a/he can attach the electronic copy.

@t Swhhss make sure you have a copy of the i-485 you’ll be refilling and attach your medical so there isn’t a delay and make sure you answer the i-485 questions truthfully ie have you worked illegally etc if you have say yes, if you’ve ever been arrested even if the charges were dropped make sure you include that part and attach the evidence of dismissal as well.

I’m so happy for you. How did you do the vase cancelation of removal, how long did it take and how long have you been in removal proceedings. I filed for vawa June 2024 and I am in removal proceedings, my lawyer is yet to file for vawa cancelation, please can you tell me more about yours. thank you @t Swhhss

@Onyame Ba Tumtum ahof3 took long 4. years. we filed and sent all evidence and I went to all hearings about 3 1/2 years ago then I was just sitting down and home and then I saw an update at the EOIR website

@blessed & favored we have filed an adjustment of status based on my immigration court case 42b I believe. we collected fingerprints and did all the stuff almost 3 years ago
