31 months later , still didn’t get my temp green card
got married to my husband in June 2021, during the pandemic. Interestingly, we were roommates before getting married, and the pandemic Work-from-home (WFH) situation brought us closer. ( first marriage at 40) had been in the States for 6 years.
However, I filed a petition in September 2021, but it got rejected twice due to my husband's three previous marriages (I only knew about two of them). I didn't accurately explain his income because COVID-19 impacted his coffee business.
In September 2023, we got an interview for i-485.
December 2023, I fought with my husband because his ex-wife came back and brought the kid to the room for school. The kid has to be with us. (his stepson, 14 years old)
In January 2024, I moved out, signing a leasing contract for 1b1b—the relationship isn't well due to his stepson's involvement.
In February 2024, I asked a congressman to push USCIS to decide. They visited the original place and found the kid and husband. They challenged me to explain why you are not living together. I proved to them that we've lived for four years (2020-2023 end), but they left.
No response.
I still need to get my temp green card after 31 months and figure out where to go.
Please advise.

appreciate your answer. if I sue them, they may deny then I have to leave the country after staying here for 10 years .
Before the pandemic, my husband and I had the same salary. However, I received a new job offer in 2020 which increased my salary fourfold. Although my husband did not earn much, he never relied on me financially. after the 2020 pandemic with a new offer, my salary has increased four times...uscis.
The husband didn't make much money ...USCIS suspects it's a fake but I got upset about this:
I spent 4 years with him, not using his money or supporting him emotionally, but I will be penalized by USCIS. I moved out because his step son moved in.
should I still sue them?

omg. I’m sorry to hear that. I blamed my current husband because he had his previous marriages filing for others . leading me so much trouble.

if you moved out after a conditional green card was issued I’d think you have a chance but this situation doesn’t look good. USCIS doesn’t owe you a green card because you were in a relationship…. they want proof you’re still in one.

it appears you are separated and no longer in bonafide marriage; your case is not approvable at the moment.
every visit from FDNS is a clear sign that uscis suspects fraud.
They found out you don't live together any more, I would expect NOID any day now...

@Eliza Day why did uscis do a home visit on your husband's previous marriage AFTER he got a 10 year green card?
once his 10 year green card was approved, he did not have any more pending cases, did he? what were they investigating?

When the time comes and you cannot wait, and cannot afford attorney, you may try to sue USCIS for a delayed case on your own, you will get a decision within 60 days. Do youtube search to learn more about it, and to get assistance with it "Writ of Mandamus Pro Se"
