Uscis will deny your AP if you are in removal processing your I-485 is not pending or your green card have been approved

@B A I did get my EAD approved, but I also put in for my I-131, I-130, I-485 but they denied the I-131

but once you’re married to usc and they’re filing for you that overstay is forgiven

I wonder if that’s why I didn’t get my 131… I overstayed by a few months after I got laid off and before I filed. not sure why they don’t let us leave the country! we literally are asking to stay!!! 😭😂😭🔫

@Nicola 🇯🇲 do you have a legal entry? did you enter with a legal status? overstay is forgiven but it is important to have a legal entry and not to be in removal proceedings. Those are most frequent reasons for I-131 denial.

@Ice Cream long story I’ve been here since I was 12 years old went to junior high and high school here and a little bit of college this has been a long process for me a lot of struggles ,but I came here on a visa and when I was 13 my father filed for me which I had no idea he did at the time until now but they closed that case because he never answered when they ask for him to submit a dna test and when I was 16/17 my House burn down and my I-94 and a lot of important documents was in burnt in that fire so now after a long process of being told i can’t adjust my status here until i can get my I-94 and ive spent a lot of money on just trying to obtain that and they told me they cant find that i came here legally etc… and i know i did anyway after my last hope and say im gonna try and partner telling me not to give up hope, i spoke to an attorney that told me because of my age when i came here and a law that president clinton had passed at the time i’m basically grandfathered into the system, so they request a rfe for me for form I-485A and i paid the $1,000.00 and submit the paperwork from when my father filed for me to show proof so i was never into removal proceedings ever never got a letter saying i was nothing

so it looks like there is a problem with your I-94. If they told you they can't find that you came in legally, then according to their records you do not have a legal entry. That's why they denied your I-131. Did you try getting a copy of your alien file through FOIA? for i-94 specifically you can check this website https://i94.cbp.dhs.gov/I94/#/home

@Ice Cream I did file with FOIA but still nothing that’s why I paid the $1,000.00 for the form I-485A
