Case Processing
Updates on our case since I-601A approval - With all timelines R1 NVC I601A
I was active on this site over the past few years, and our I-601A was approved back in early February. Today we were marked Documentarily Qualified and now the wait begins for our appointment either in Cuidad Juarez, or if President Biden's "Parole in Place" plan is finalized with details soon, we hope the interview will happen in the USA. Here is our timeline so far:
August 2, 2019 = I-130 Receipt Date
March 26, 2020 = I-130 Approved
August 28, 2020 = I-601A Application Received at USCIS
September 8, 2020 = Fingerprint fee accepted
June 2, 2021 = Fingerprints were taken
July 17, 2023 = Application transferred to another office
February 1, 2024 = I-601A approved
+++ Lawyer wanted us to submit a FOIA request to ensure record was clear before he submitted paperwork to NVC. More details below+++
April 3, 2024 = FOIA request submitted
May 28, 2024 = FOIA result received
July 5, 2024 = Applicant's documents/Sponsor's I-864 submitted to NVC
July 12, 2024 = NVC indicates Documentarily Qualified
It should be noted that the Applicant in this case crossed into the USA about 25 years ago, was apprehended and returned to Mexico, and re-entered 2 days later and stayed. He was not actually "processed" or taken for any kind of hearing. Our attorney wanted to submit the FOIA request just to ensure that was the case and there was no other history, criminal or otherwise. Our primary disappointment was that we feel the attorney should have done the FOIA request when it was apparent the I-601 approval was likely near based on timelines we were seeing from other applicants. In this case we feel months were wasted between the time the I-601A was approved on February 1 and we finally submitted everything to the NVC for review as we were just then told he wanted the FOIA request done as well.
It's our attorney's hope that all his vigilance will help move the interview along faster and streamline that process. We can go there with the approved I-601A, documents submitted to the NVC, the FOIA request result and other supporting documents and the officer will see we did our homework and came prepared and the approval will come quickly. Fingers crossed....

Hello,
One quick question as I am curious how will this work.
If you apply for sibling or parents applied for adult.
What date will be mentioned on I-797 , if they approved within a year or later how the NVC process works from there? Is there a way to speed up the process ?
Can someone pleaser share their experience to help me understand ?
Processing time
Processing time is dumb. USCIS needs to remove it, it’s pointless. when you login on your account to see some positive changes, it is the only thing that changes and 9 out of 10 times the processing time increases. No matter how we ignore it, it plays on our mind. it’s jus an irrelevant feature. my I 130 and i485 has been 4 months and 3 months respectively for the past 2 months now it’s at 14 months and 10 months.

I-751
Hello,
I am filling out my I-751 divorce waiver and I am confused as to how to respond to question 21 and 23. I know this question might seem silly.
Question 21: if you are married, is this a different marriage than the one through which you gained conditional resident status?
The option is just yes or no, but the question has a conditional statement of “if you are married”. I am not married, so do I just leave the question blank?
Question 23: is your spouse or parent’s spouse currently serving with or employed by the US Government and serving outside the United States?
This is also a yes or a no question. Do I just leave it blank since I have no spouse?
For those who have submitted and gone through this process, your candid answers would be appreciated
