WRIT OF MANDAMUS
So I filed in July/2021 and I am tired of waiting so at this point I am going to file a writ of mandamus
Any guidance on how to file it, Is highly appreciated. Thank you

just wait, you’re not the only one! processing time is 40 months, you are at 36, so I don’t understand why you try to fight with USCIS. I suggest you to wait. I am on same boat, just 2 months difference. remember, if you decide to file writ, there will be no rfe. so if something is missing or not clear they will denied you

Not true about RFE, friend filed mandamus recently, after a while they sent RFE, he replied, and the case was approved after few weeks.

If you can afford attorney, average $5000, hire Hacking Immigration Law or Joseph Gentile (SARRAF GENTILE LLP) or cheaper option, you do it yourself with assistance, youtube "writ of mandamus pro se"

@survivor p, don’t believe what USCIS says about processing times. this is made up times by USCIS. They are mandated by congress to process cases within 180 dayd

@dipu 78 Lol, I am the last one who will believe USCIS but first, just look how many VAWA cases USCIS receive each year (around 28,000), and how many decisions they make (around 10,000). So it’s obvious wait time is long (40 months is kind of real time). Second, USCIS doesn’t have to process all cases in 180 days, that’s not the rule for all type of cases. third, I don’t encourage people to fight with USCIS (mandamus is kind of fight) - just imagine officer who decide about your case, and your case is 50/50, and then officer see you write for mandamus lol. And the most important, we all wait on average same time for decision. Why should I wait longer because someone is NOT patient!?
