WORK PERMIT AND ADJUSTMENT OF STATUS
hello
i just check my lawyer and they didn’t send my work permit and adjustment of status with my Vawa petition.
can I send them now?

you can't file i 360 and I 485 concurrently, if your spouse was a resident. you have to wa8t until you get i 360 approved. You can only file i 360 and i 485 concurrently if your abusive spouse was a US citizen.

@Ashraf Ahmed why do you mislead people with wrong information? yes, you can file your 485 and 765, 131 now. I filed my 360 then after 2 months I filed the rest of them. just don’t listen to people who don’t know the law.

because as far as I know, generally a VAWA self-petitioner married to a green card holder (lawful permanent resident) cannot file Form I-360 and Form I-485 concurrently. Concurrent filing, where both petitions are submitted together, is typically allowed for immediate relatives of U.S. citizens, but not for those married to green card holders.

@sweet lins no idea where you found this information. it’s completely wrong . you can file concurrently, but if there are not available visas then they should wait for a visa availability. he can file concurrently or later , either way works to get EAD and TRAVEL.

@Daniel Ad sir? did you read your comment? you did not file i 485 concurrently. you submitted your I 485 2 months after your submitted your other apps. and yes you are right about the visa availability. plus just to inform you, I myself am a law student. so please refrain from claiming that others dont know the law. you can not file i 360 amd i 485 together, if you are not married to USC. It is as simple as that.

@Daniel Ad YOU CANNOT FILE I-360 AND ADJUSTMENT OF STATUS CONCURRENTLY IF YOU ARE MARRIED TO A RESIDENT. YOU HAVE TO WAIT FOR THE I-360 TO BE ADJUDICATED AND APPROVED. You see I have them all in caps so you won't mislead anyone. Be it you file 2 months after or 6 months etc. You have to wait for your VAWA to be approved. For your info a resident is a green card holder and not a citizen. Just in case you missed that part or don't know the difference. However from your various post I presume you filed for renewal of your EAD based on your previous case that is different from VAWA before switching to VAWA. That is different because your i-485 is in abeyance and stands alone from your VAWA.

If a visa is not immediately available, you must first file and get Form I-360 approved. Once it’s approved and a visa is available, you can then file Form I-485 to adjust your status. This often applies to VAWA self-petitioners who were married to a lawful permanent resident (LPR).
