work permission category issues
hi. I just noticed that my attorney put category c31 on my work permission application. does it mean I will be waiting until vawa is approved? what can I do to expedite it? he doesn't answer on my emails and I am really stressed. I can't really afford to live another two or three years without job and a car. I am single mom and we don't have any family to help us.

C09 category is for I 485
C31 is for I 360
in I 765 form what category the lawyer put? it should be C09 or C09P.
if the lawyer put C31 in your I 765 then you are in trouble.

@little mermaid you have to file new I765 with C09 category. to be honest with you… you paid your lawyer and he clearly made a mistake. he should file it for free for you. that’s his mistake. ask him to do so

thank you both for advices. it looks like I can already have ead card as I applied a year ago. now all the process will start over if I apply again? or it will be faster?

@little mermaid what you need to do is to apply for a new I765 and change the category to C09. you don’t need the lawyer to do that if he doesn’t want to respond to you then do what needs to be done cuz if you are awaiting for C31 then that’s going to be a long time trust me. make sure when you are sending attach a cover letter saying you are applying under the category of C09 and just be patient. in no time they will approve it. you don’t have to stress or panick. all is well okay

My attorney made a similar mistake but in my case he used category C08 instead of C09. Note that C08 is for Asylees. I do not have any pending Asylum case. When I found out almost two months later, I brought it to her attention but she dismissed it saying it doesn't matter. Still not convinced, I sought a second opinion and was told that I should file a I765 category C09 and withdraw the wrong one my attorney did. So I went with the second opinion without my attorney's consent. The new EAD was approved earlier this month. So my advice. File a new one under C09 category since you have a pending I485. Ask for the C31 your attorney filed. you might need to withdraw it because the C31 EAD is automatic, once your VAWA gets approved.
