Withdrawing a VAWA Petition After RFE Response - Implications with a Pending EB2 NIW AOS
I have a pending VAWA (I-360) petition where I already responded to an RFE, but the decision is taking a very long time.
My situation is a bit specific: I also have an approved EB2 NIW petition, and my I-485 adjustment of status application from that NIW is currently pending.
My questions for the community are:
1. Is it possible to voluntarily withdraw my VAWA petition at this stage, after having submitted the RFE response?
2. What are the potential implications of doing this, especially since I have a separate green card application (I-485) already in process based on my EB2 NIW?
3. Could withdrawing the VAWA petition affect my pending I-485 or any future immigration applications?
If anyone has gone through a similar situation or has insights on the procedural and strategic aspects, I would greatly appreciate your advice.

You need a ground to adjust on i485 which is how i360 and EB2 NIW comes in, so if you have an approved EB2 NIW, just make sure the i485 is being adjusted on the ground of an approved EB2 NIW, but if you have the i485 pending based on a pending i360 then withdrawing i360 will be a problem, so it’s best to make sure you have an i485 to be adjudicated under approved EB2 NIW and not i360, then you’re safe to withdraw your i360 it is not problem at all in as much as you have other means approved to adjust the current status you have.

@olu mikk I was in the same situation. what you should do it let uscis take the decision. you let them be. they will just close the application which is not needed.

just let your application be. it’s like someone having a Vawa processedings while going to get married. it will automatically void. if one get approved the other one will void.

please don’t withdraw your vawa if you are applying due to marriage with a citizen and already have accrued unlawfully presence Time. if you HAVE do not withdraw vawa but if you haven’t you can withdraw vawa. This is because vawa will forgive your accrued time but for you to get your green card through EB - Visa category you need to have stayed current and not accrue time. This is exactly what happened to Jane Eugene. you can check it out. she filed I-140 but they did not approve it because she hey said she has accumulated time unlawfully so she got picked up by ice in May

Do not withdraw any application. just make sure you get a lawyer . am sure lawyer will make sure you have i485 for the aproved EB2.
