What’s the best way to submit the Removal Proceedings Dismissal’s Letter to USCIS ?
I called USCIS for an infopass and i was informed that I should receive a call within 30 days. I am also wondering if I can upload the termination letter to my account to save time ? if yes, will that cause a delay in any forms ?

The wanderer@ I had removal dismissed on June 2022. since then I have wrote to them, field office and NBC twice, called them numerous times. uploaded Judge 's order on my account and contacted my congress person they responded to give the 90 days to adjudicate my case, nothing happned I reached out to my congress person he said he forwarded the request again and to give him 14day for uscis to respond. I will keep you posted if any update. please do the same thank,

That means the field office was able to see the termination letter despite you did not hand it in person. I will try to upload it as well. Did you receive any of sort notifications acknowledging they received the motion when you updated it?

how can you guys can apply for green card when your case is in court,I was waiting about 5 years to judge dismiss my removal and then after 5 years my removal case discussed by judge and then after that I could apply for green card,when I got a lawyer 6 months after my removal case dismissed

@s k You can apply for green card when you are in court but if you decide to adjust with USCIS, the court has to dismiss your case. Your proceedings have already been terminated and you should have already filed for adjustment of status with USCIS as they now have jurisdiction over your case.

I uploaded the termination letter to my account and will hand it in person when I receive an infopass appointment with my field office.

sk. always can apply for greencard through USCIS but USCIS won’t be able to approve it until the removal proceeding is terminated. USCIS will admin closed I-485 until the person got the immigration court termination letter

There is not a standard way as it is relative to each person experience. Having my master hearing really helped me with the motion. My lawyer reminded the DHS attorney that a motion to dismiss was previously filed and that we are looking to terminating the case. She agreed on the same day and a few days later, the case was terminated by the court.

the wanderer : 7 months OPLA never responded to my PD request. lawyer refused to do anything else beside waiting for PD request ( I was like for how long ? until I die ? ) I chased him for 6 weeks before he said he will file motion to terminate directly to the court before New year. let see how it goes

@ms domino working with some lawyers is extremely stressful, frustrating, and mentally draining as I have struggled a lot with my lawyer. Please let me know if you need any other help, I know what this feels like. Electronically filing for PD did not help me, i think you should try find who the DHS attorney is and email the person directly. But i hope the court dismisses your case directly without the DHS attorney. Fingers are crossed!

@ms domino Yes, you can not find the DHS attorney email but your lawyer can through the court online portal account. Only that person can join the motion to dismiss.

Your lawyer knows the government attorney that will be attending your individual hearing. It just can be hard for DHS to share that email with you because you have a legal attorney that represents you.

for those who are still in removal and have I-130 approved you might be better asking the court for advanced hearing on your I-485 instead of terminating the case and having to go back to uscis and God Knows when they will schedule you for a hearing. My removal was terminated 6 moths ago still haven't heard back from uscis any updates on my I-485. I notified them on the dismissal of the case

I really don’t know about other people but having the proceedings terminated on my case truly made me feel better and less anxious. I don’t like the court.

@ Abdou I agree with you . if ur hearing is close and u have your i130 approved better u do your i485 in court bcos it’s more easier and quicker. I am on the same boat my lawyer said he want me to get my green card quicker and since my hearing date is close he would suggest to me to file i485 in court . his reasons was if I terminate my proceedings my case will first go to nation benefit center and they will then notify my local office , he said that might take another 12 months or more before I can get interview for i485. I agreed with him and he filed it through courts so I am waiting now . … this journey is really discouraging but there is light at the end of tunnel.

@domino 22, Last week I applied for work authorization and travel document and I attached the termination letter with a note to NBC. Today i attached the termination letter again with the receipt of the I-485 and a letter explaining that the proceedings have been terminated in court and mailed all of that to my field office. I should also expect to receive a call from USCIS within 30 business days and they might ask me to resubmit the letter again. let’s see.

@Abdoul Yes, I think getting an infopass will be one of the best options as your case is admin closed but I am certainly sure they will reopen your I-485 as they’ve received your motion. I read many stories on this app and people were able to successfully have their I-485 reopened after filing the motion. I am sure USCIS will get back to you anytime soon.

@ kj mine took 22 months December 2020 to oct 2022. . my interview was very intense I was separated with my wife . when u are in removal proceedings they intentionally delay your i130 cos they want to see if u will have problems with your wife . make sure u know about ur wife family , address , financial, and any other supporting documents . just prepare well . don’t be frustrated God is in control.

Free man@ thank you for sharing with us. Mine tool 14 months. The interview was really smooth, it was more of a friendly chatty convo. However the officer was going though the supporting documents while talking to us. we also provided a lot of proof when we submitted tye application. decision was issued the same day, approval. thanks to the almighty Allah.

19 months. Nov 20-Jun 22. the IO didn’t separate us more like chatting with nice neighbor ( turned out she indeed live not far from us and she knows our roomate’s dog ). I brought tons of evindeces and she took it all

boston is not slow with PD. Boston didn’t touch the PD at all and my fricking lawyer refuse to do anything beside waiting for OPLA. I was like do we have deadline? until I become skeleton ? I’m so mad

Do not let lawyers handle your case on their own, you have to be behind them at all time especially with pd requests. My lawyer was the same thing as I used to book flight tickets to NYC just to tell him to follow up with him.

Yes, I did. The DHS attorney agreed to join the motion on Master hearing’s day. And on the same day, they dismissed so many cases in court as I witnessed it.

I think the problem is do you have a lawyer who can keep following up with them. The court is backloged and judges are tired of getting more cases. They want to dismiss as many as possible.

I believe if you file it with the court directly, it will work out. Either the judge will approve it which we’re hoping for or else he will forward the request to the DHS attorney. In this case, the DHS attorney will have to reply to the motion because it is coming from the judge, the immigration court.

I’ve been terrorize my lawyer since November. once a week I emailed him and didn’t stop until he responded to me ( 5 weeks later ) and since his response has no meaning, I keep emailing him until he gave up and called me and said he will file motion to terminate directly to the court by new year. after new year I will terrorize him again. it’s getting out of hand. shit lawyer is the worst. I want to fire that lawyer long time ago but my husband keep telling to me to hold on. my individual hearing is in September 2023 and I don’t want to wait that long

This is completely frustrating. In my opinion your lawyer is not following up and is being negligent. OPLA is vague, he should email the DHS attorney directly. But I am sure once he files it with the judge, it will get dismissed. The judge will be happy to take you off the calendar and dismiss your case. They are extremely backloged.

Also, remember one thing, lawyers don’t like their clients to terminate their cases as they will lose money. When you are in court proceedings, that’s when they really make money. So, they have no genuine interest in helping their clients terminate their cases.

update : emailed lawyer today and got response that they filed motion to terminate directly to the court on 12/23/22. didn’t bother to tell me if I don’t reach out to them. I got the copy of the motion that’s how I know that they filed it 2 weeks ago

Some lawyers are just interesting and unreliable. Yes, i used to call the court and the clerk from time to time to get an update on the PD request. You certainly can do it.

The reason to call is to put your mind at ease and get faster update on the motion as opposed to waiting for your lawyer who is not replying to your concerning questions. When i call the court, i told them the reason of the call which is to get an update on the motion and ask to speak with the judge’s clerk. Do not put pressure on the court by calling too many times, just follow up when necessary.

@The Wanderer Married, F Removal proceedings Jan 2020 Filled i-130 and I-485 Feb 2021 I-130 approved June 2023 case was terminated. last Aug 2023 Lawyer filled medical for my I-485 together with the Termination. Oct 17, 2023 I chatted with EMMA, talked to tier 2 officer. Forwareded my I-485 request to expedite. Received a letter from NYC federal plaza USCIS “We are reviewing your case, unfortunately we cant provide a specific time frame….. so its been 3 years plus since i was in removal proceedings what should i do ? my lawyer sucks. she doesnt care at all.
