what are our options
can anyone help us, we have tried contacting USCIS, local congress, state senators ( didn’t get a response ), inquiry ( apparently we were still within processing time ) , actual officers at USCIS on the phone and a lawyer, the lawyer from Dallas who my wife spoke to said it is possible for us to file a i485 and i765 and I could stay there while it processes but we only have until the i130 is approved and after the 90 days I’ve been in the US, I wanna try contact a few other lawyers just to confirm if it’s true or not. I don’t care what the laws are currently I will not be missing out on Christmas away from my family again

@ash azaoy how can you go there and adjust your status? I got told I have to wait in my home country until the whole process is done because it is not allowed to stay in the US on a ESTA and wait for the spousal visa to be approved. Is there a way? because all I want is to be with my partner

I talked before with lawyer there is something called adjustment of a status. allowed you wait there . but unfortunately, I don't have visit visa

@Jacob Needham Have your wife file an FOIA (Freedom of Information Act) inquiry. https://www.foia.gov/. This will force them to share your entire case activities with you.

@Lena S. my wife is consulting with a few different lawyers to confirm it’s 100% true and it would be better for the lawyer to file the form for us so it doesn’t come back onto us in the future

@Jacob Needham it is an agency that will demand a government agency to share information with the person that it involves. She fills it out asking for information to be shared about the USCIS case. FOIA will pursue them forcing them to share information with her about the case. I read one other person from another forum that did this, and that got their entire case record including the name of the person who had been assigned to their case.

I thought the adjustment of status form specifically said that you cannot file from visa waiver (ESTA). If you are filing from abroad and want to be reunited with your spouse you are meant to file k3 visa. Alternative the visitor visa does qualify to be used with adjustment of status. Of course, there are “forgivable” workarounds that aren’t quite follow the rules but I would say you don’t want to risk those during this administration. If you have already been waiting for a year in my opinion the risk of breaking the rules and being made an example is just not worth it. We are in the same boat with my husband. Also, if you have a lawyer you may not be on the hook legally but if your case gets denied or worst you get removal proceedings against you that does affect you. Unfortunately a friend of mine got denied because they got bad legal advice - always do your own research and read the instructions. Stay strong everyone, we can’t wait forever. I know it’s hard
