we came through the border 2022 me nd my husband,filled our asylum since 2023,up till now no any feedback each time I checked it keeps telling me next step is an interview in person,I-589

@Amina Yusuf how did you end up with USCIS and not court if you came via the border?

when my lawyer submitted our application,we received a letter from immigration,stating they have received our application but is pending,so whe I check the status with the receipt number it shows me next step is an interview in person,

@Amina Yusuf You have two possible outcomes here:
1. Just wait for your interview with USCIS. Right now USCIS is calling for interview people who applied for asylum recently and those who applied 10 years ago. However, you might get interview any time so nobody knows when.
2. When your file is opened by USCIS officer and they see that you entered via the border, your case will be forwarded to immigration court because USCIS does not have jurisdiction over your case because of the type of your entry. Finally you will be able to pursue your case in front of the immigration judge. I believe this is the likely scenario.
Of course in no way am I an attorney and this is my personal opinion. Others might chip in with their ideas as well here. So for now you’re just waiting. Perhaps you could look into mandamus if you believe you’re eligible to force them to schedule your interview.

@Amina Yusuf you have to IMMEDIATELY fix your case….Parole at the border doesn’t qualify you to process your asykum case eith USCIS…..right now you are waiting for USCIS to open and then Terminate your case because Immigration court SHOULD have jurisdiction….it happened a lot….idk why lawyers would do that….unless you entered legaly with visa or other stuff your case shoukd be with court and USCIS CAN NOR grant you asylum…

I too passed the border at 22, my case is with USCIS. My attorney and I are now contacting ICE to take the case to court. So far, to no avail
