Dumb question, please what is the problem with porting?

@Rijo Rijo well, in today’s context - it’s like someone buying a new house in 2024 with mortgage rate of 2021.

It may be frustrating for few but it is totally legal! Moreover, it is not just switchover from EB2 and EB3. It has to go through entire process of eligiblity , sponsership by a company and also validation and approval by USCIS based on the immigration law.

@Gan H @Rijo Rijo nobody said it’s anything against the law! We all understand that being eligible for EB1 is difficult and kudos to anyone who becomes eligible and applies for i140. Till this point everything is great, but the problem is someone porting gets to jump the queue based on an EB2/EB3 i140 which was applied at a point when that person did not have the same qualifications/eligibility!

@Champ Boy - agree where were these people till now ? why 2016, 2017 are porting now not at the time when PD was current in 2020, 2021, 2022

@Rick S, I agree. it doesn't help most people. The whole process can be "unfair"!

@my moto the majority of the folks who are stuck in GC line fall under EB2 or EB3 category, whose PD is anytime after 2013. After so many years (more than 10 years), they have gained significant professional recognition, promotions, etc, because of which they are able to file under EB1 category. Thats why they are all porting now. Maybe suring 2020 21 time-frame, ppl whose profile deserved EB1 already had gotten GC via traditional route like EBe or EB3.

I agree , porting is fine but people should be placed bases on their application date not by previous priority date

so true, this porting is too much. my case is in CRP for 1.3yrs now :(
