Do research to see if there’s a Women in Distress organization that can assist her also. I know she’s afraid, but she should really get a police report filed. I filed for Vawa, but my case is very difficult to prove because I didn’t suffer physical abuse. I had to prove financial & mental abuse. My case STILL hasn’t been resolved. Anyway, her best bet is to start collecting affidavits from anyone willing to write a letter on her behalf who has witness the abuse. The more evidence she can collect, the better it will be for her case if she doesn’t want to file the police report. In the meantime she will need the following items: Immigration medical examination Immigration Psychological examination (by a licensed psychologist) A background check in all the states she has lived A letter regarding her moral character (friends can write this) Affidavits from people who witnessed/know of the abuse Documentation proving that she lived with abuser (electric bill, mortgage, phone bill). Make sure her name appears with his on some bills Evidence of abusers status - citizen (provide naturalized certificate) Proof of relationship (marriage certificate) Definitely find out if there is a Women’s in Distress organization near you. They can help her out w/housing, food, clothing, too much for me to list here. Hope this info helps - good luck!

let her speak to a lawyer. but if she has text messages threatening her or saying abusive stuff or admitting to hurting her then that’s great she needs proof that she lived with him first and foremost and she needs proof that he’s a citizen either a copy of his birth certificate or passport and proof that they have a child together would also be helpful and also she needs the pictures of cuts that she got from the abuse or whatever else she has and affidavit from people that know he’s abusive she don’t need a police report .

him cheating isn’t abuse but speak to a lawyer and she’s more than eligible to file for vawa she don’t need the child she will be filing on her own for her self it’s a long process it takes 2-3 years sometimes less or more but she needs out of that situation ASAP. he will not go to jail neither will he know that she is filing for herself everything will be secret. but she needs proof that they lived together like mail for her and him bills lease bank information or affidavit from neighbors anything but they need that

if he’s a usc she has to file for vawa 1360 work permit i765 adjustment of status green card form i485 if she wants to travel i131 advance parole but please let her do her research cause she don’t need to make any mistakes and get put in removal processing so let her be safe and careful

Just an update I went with her to the building to get at least the lease office to get her contract an the guy never added her in the contract and denied her to get anything from where she lived.

Kev, that’s fine. Tell her to keep collecting as much evidence. Even though she isn’t listed on the lease, will the leasing office or landlord be willing to write a letter stating that they are aware that she was living there at the time of the abuse? In my case, even though I’m on the electrical account, my name does NOT appear on any bills that come to the house, as my name was added to the account much later. I got a notarized letter stating as much, but I still provided other documents that showed both of our names at the same address on other documents (bank statements, cellphone bill, tax receipts). The process will be hard at times, but keep pushing, she’ll get through.

@kev yes it’s okay if she had spoken to anyone in the building that can write an affidavit stating that she’s the neighbor and she’s been living there and even the landlord or the super. me and my husband didn’t have anything at all he only had his checks coming to my house but we had mail going to his moms house which I provided both but in my defense I used my personal address where he came to live with me almost a year but he wasn’t in the lease. but my landlord gave me an affidavit cause she up my rent when he moved in with me. and if she lives there she can call the cops and have them follow her in the house to get her belongings and there’s nothing he can do but she needs get the cops involved cause when I called the cops on my husband they escorted him to take his stuff out my house and she needs to be mentally prepared to grab What’s hers. all the mail if she has a drivers license with his address or any mail from Amazon or just anything a bank letter or a mail from a friend anything that has his name and address and her name. u need to get any mail from him also that has the same address that’s key and she needs to get a copy that he is a citizen or else she won’t get anywhere in her case a pic is fine must be clear his birth certificate or passport.

I understand thank you. But its a big fancy building where they dont want to involve themselves. As I mentioned he has talked to everyone in the building as he lives and works there. So he convinced everyone she was the crazy girlfriend. And he is basically very good frineds with the leasing office assistants. So there is no way of her obyaing a letter from that building period. What if we the family living with her now can write about the problem? im sure we can but prove that she lived there and we went over for dinner will help correct. we did get a copy of his lease contract and invoice of him paying the rent with the address.

Kevin that's common in matters like this. Does she have ANY friends or someone who WILL vouch for her living there & knows fkr a fact that they resided there together? If so, get it on paper & get it notarized - it'll carry MORE weight than someone just writing an a letter saying that you lived together. Yes family members can write letters w/their pov (point of view) of what they witnessed. My mother wrote an affidavit for me & I had her hand write it (she's not computer savy).

Yes Liza I have filed Vawa. Unfortunately I'm working w/an atty who doesn't keep me abreast of things on my file. I should have been called for my interview by now, but I believe in my opinion that she's been filing stuff late as she keeps requesting extensions. Uscis had requested an RFE since April (I found out about it in June). She got an extension for that. Smh She JUST submitted it ON the deadline on the 19th, which was Sunday. I REALLY hope I can come back on here & have a happy ending to this crazy situation. I filed for VAWA in Sept 2019. Let's see what happens. I just want to help others, so their immigration experience will be smoother than mine. My atty hasn't even told me that I'll probably have to do another medical exam. Thank God that I've saved the money for this extra expense.

Thank you so much Liza, that means a lot to me. I'm mentally exhausted dealing w/her. I'm now on high blood pressure pills dealing w/her. I have NEVER in my life had issues w/blood pressure. I got my first EAD when I was w/my husband. Married in Oct 2017 Filed docs in Jan 2018. Biometrics in February 2018 Ead 1yr in Sept 2018 Filed Vawa in Sept 2019 1st Prima Facie Oct 2019 -2020 I've never received an EAD since working w/this atty. She says she sent the paperwork out in Feb 2019 & she says it got lost in the mail that's why I didn't get it. Ridiculous! The i485 i360 765 all were Filed at the same time. It's better to do everything together so there's no back & forth w/USCIS. Nows it's a waiting game for me. Some ppl say it takes up to 36 months to have the Vawa approved.

Thanks. Yes I heard about ppl waiting since 2018 for movement on their case. The thing I’m baffled about is the EAD. How are we supposed to support ourselves in the meantime. Someone said that you will NOT get an EAD until your case is approved, but by then you won’t need the EAD as you’ll have your Greencard. I just can’t believe that. I’m too tired to be worried about my case anymore, it’s like I’m too mentally exhausted. I just pray I can get approved before the end of the year, because I don’t want this disruptive energy going into 2022.

I’ve heard that u only get the EAD when the i360 is approved but I’ve seen people get the c9 EAD before it’s i360 is approved but u gotta hope because after i360 is approved that’s when your i485 will process I saw someone had their i360 approve and they’re waiting 2 years for their green card that’s a next process too everything is process once even when you file them all together

Liza, I’ve heard that too. I’ve even heard about people having they’re interviews waived & they got their Greencards. Each case is different & underwriters/processors will be looking for certain things. I just got a notification that they received my RFE ‘yesterday’ (was due back on Sept 19) & that they’re working on it again. The next step is the decision.

wow are you serious that’s crazy. and when I saw my attorney on FB I called her an paid but she didn’t answer all my questions so I didn’t bother filed but I decided to call her again and she answered all my questions so I went to her she was expensive but as of now I don’t regret it thank God she filed my stuff 2 days after I got receipt notice then 1 month after I got biometric appointment then I got prima facie days after that. I know I still have a long time to wait but I was really picky girl I made sure I had all my stuff she sent me my package it was like 300 pages and I read everything even pointed out my mistakes cause I didn’t want an rfe but who knows what the future holds I’m staying positive tho.

WHAT? 2 days after getting the notice? That’s fantastic. Your atty sounds like she’s on top of her stuff. In the beginning I kept telling my atty to include my Psychological exam w/the pkg so the underwriter isn’t picking at my file as my abuse wasn’t physical, so I knew I would have to supply more info. She told me no, let’s wait & if they ask for it, we’ll send it then! That made NO sense to me, as I knew they WOULD need it, It cost me $500, so they better need it. When I read the RFE it asked for it if I had it. I completed it in 2019 in time to send w/the pkg. It’s just nerve racking that she doesn’t respond to anything in a timely matter & this is my livelihood she’s playing around with. I have stressed this to her so many time, but she does what she wants to do. smh It’s out of my hands now & the file is where it needs to be & that’s all that matters now.

I already told my atty for the amount of money she charged me ($8k) the service she provides isn’t worth it! My mother paid her $1k monthly. We went w/o a washing machine & a/c when they both broke down. No air conditioning in So. Florida in summer. Even my pets were panting. I just feel like crap as my mum worked hard to pay her & she just doesn’t care. She got paid in full & I’m getting this type of customer service. Last year I reached out to my atty for 5 months straight she just wouldn’t respond. If I was working I would have obviously hired a more efficient atty, but it is what it is right now. I’m doing my best to stay positive but when you’re working w/someone who doesn’t cooperate w/you, they make it harder than things need to be. It’s like she’s trying to sabotage me or something. I’ve never experienced anything like this.

Oh yes! She wanted the entire amount upfront & I told her no, that’s impossible. My mother is a senior citizen, who happens to still work as she’s still quite strong. I told her that if she can accept monthly pmts we can do business. Trust me, if I could have found an attorney in my area that handled Vawa cases, I wouldn’t have hired her. It has been nothing but headaches. A Prima Facie is usually good for 6 months. I don’t know what the heck she’s been doing with mine, but by the time she gives it to me, it’s only valid for a month IF 7 weeks. I’m beginning to think she’s overwhelmed & doesn’t know how to prioritize ~ this is the wrong business to be in. People trust you when you claim you can do a job but show otherwise.

my attorney was in my area an hour away but she moved 30 mins closer but I saw her on Facebook she was talking about the immigration stuff and I was like Ohok maybe I will call her initial fee is 150 so I was like Ohok and I wanted to make sure she was the one for me I’m so sorry u didn’t get someone good but at least she’s competent of what she’s doing so that’s a plus. but the prima facie don’t do anything for me I try to apply for health care and was denied

My first Prima Facie was for 1yr & w/that I was able to get my driver’s license which was also for 1yr. Every Prima Facie since then has been for 6 months. I wasn’t able to get my license earlier this yr because by the time the atty gave it to me in February, I had to wait for an appt w/DMV. By the time I did secure an appt, the license would on,y be valid for 1 month because it was expiring! Now This 3rd Prima Facie I got from her in July….smh even though it’s printed April - Oct 2021. I renewed it July 15, I had to pay $63 because I was renewing it late. It will exp on the 4th of next month. Can you see why I’m so anxious? I’m not in control of ANYTHING because it’s a Vawa case, everything is going to the Atty’s address, & she NEVER gives me an envelope so I can’t check the stamp date. I highly doubt that a time sensitive document would take 3-4 months to get to someone.

I didn’t get any benefits besides being able to renew my driver’s license w/the Prima Facie. When I did try to get some kind of health assistance, ppl don’t even know what a Prima Facie is! I’ve been going to a low income clinic in the next city over from me. There, I’m on a sliding scale so I pay a small fee for the office visit, & any lab work is at a discounted rate. I go through a program to get a no cost mammogram also.

I’m here in So. Fla & w/all the immigrants here, you would think ppl would be a little more knowledgeable about such documents, they don’t. This atty is doing everything by herself. That’s fine & I know a lot of them do this, but if the job is too much, hire a student to make copies & take stuff to Fed Ex etc. No, she wants to do everything on her own & rather send shit in late than get help. When she went w/me to the GC (marriage) interview, I nearly fainted. She brought the Vawa pkg w/her. She printed/sent it out the SAME day as my interview. I had met w/her weeks prior & just assumed that it had been sent out already, as she told me that’s what she was going to do. It’s been a circus ever since. The more I tell her to get her stuff together & not wait until the last minute to send my stuff out, the more she rebels & does it her way. Why can’t I win millions of dollars on a $5 scratch off ticket & be done w/all of this???

Reckless! And she doesn’t change her ways. No matter how I talk to her about how she’s handling my case, or how many times The Bar reaches out to her to let me know about case status. She does what she wants to do, because she knows the bar isn’t going to MAKE her doing ANYHING. I spoke to them on Monday & the atty from the Bar who has been reaching out to her on my behalf told me that the Bar isn’t an advocate for clients, all they do is reach out to the atty on a clients behalf. So WHAT are they good for. Right now, there just isn’t extra money to hire an advocate to help me find out what’s REALLY going on with my case, so here I am present day, having to be at this atty’s mercy. Smdh

Me and my sister in law are looking for attorney but they are mad expensive. im trying to see about pro bono attorneys but let see. Another incident happened with my sister In law the hospital never checked if she was pregnant and they did ex rays on her on friday and just yesterday she found out she is pregnant from this ex husband. She is crying her heart out. now she has 2 kids and no job nothing. and she we have a copy of his ssn, birth certificate, and his original passport. and all his Mail savage🤷‍♂️. But my question is does she really need a psychologist report?

yes a psychologist report is needed even even tho I was physically abused he still verbally and emotionally abused me and that’s what that proves to show how you’ve been hurt and you’re at a disadvantage by you’re spouse. and that’s great u guys got a lot from him and the fact that she has his kids or kid is prof enough I wish he had sign the birth certificate but even that let her take his ass to court for child support!! she needs to not stress out and getting a psychological report from the stress and in her condition is good too but I would recommend her to keep the child cause it’s proof they were in a relationship even tho it might not really matter maybe not sure but does she have a copy of the marriage certificate??? she needs that and whoever was her witness at the wedding our court let them send in signed affidavits. vawa is something u can do yourself it’s not hard plus the only fees u pay for is the adjustment of status the fingerprint and report but it’s not easy doing it by yourself so she will need support. they’re agency’s see that she can call in her state that provide shelter and help and some even have people how’s familiar with these kind of stuff so she can find someone to help. what did she need a X-ray for? did he hurt her that bad? if so she has to keep copies of the doctor visits and stuff pics of her bruises and let her text him to see if he will say he’s did abuse her so she can use it as proof u gotta text him in a way he will admit it let her use the fact that she found out she’s pregnant and telling him so he can confess

I’ve waited this long, so what’s 2-3 months ? @Kev ~ Yes you’re right, the atty’s are VERY expensive. They know that we need their help, so they hold the cards in a way. As your sister did go the hospital & she has a small amount of evidence, try Legal Aid, or some other pro Bono organization. They didn’t help me because they said I didn’t have a police report & didn’t get beaten up (that was harsh to hear). They can probably help her. We’re here to help you & your sister, so ANYTHING we can think of, we’ll give you all of the tips & advice. I’m glad that you guys have some of his information. I know your sister isn’t in the ideal situation, but don’t lose hope. Do ALL you can to raise the money for the Immigration psychological examination. It’s needed if you’re going to file for Vawa. See if there are organizations that help w/Immigrants getting atty’s, or these type of examinations at a low cost. Here in South Florida, we have very large Hispanic/Latin & Haitian communities & they all have their own organizations that help them w/matters like this. If you don’t mind answering, where are you located? I could try to do some research to help you out. Liza gave you fantastic info. Use ALL of it, I agree. Vawa can be tricky, especially when you don’t have ALL of the documents to make it a slam dunk case. See what agencies will help you.

@liza liza Her mother in law stile her marriage certificate. She asked for a new one when she left the first time and never supposedly received it so she is asking for a new one now. she only has a copy when she filled out when getting married.

@Liza ~ I’m staying positive & I’m going back to my manifestations. I was pretty good at it at one time so there’s no harm in getting as much help as I can. @Kev ~ Find how much a copy is at the courthouse. She can definitely get a copy of the actual certificate there.
