VAWA RFE after 4+ years and FRAUD INVESTIGATION, RFE for bona fide marriage
have a pending VAWA case from 2021 and I just received a RFE asking me to prove that my marriage was bona fide. The problem is, I don’t really have strong documentary evidence. Most of the ppw was handled by my ex-husband and I don’t have access to things like a lease, utility bills, or joint accounts. We’ve been separated for about 5 years now. What I can get is statements. I can probably collect around 5 even to 10 affidavits from people who knew us as a couple and can confirm the marriage was real. I’m also wondering if I should include additional things even though they didn’t specifically ask for them, like: • my ongoing therapy records • medical/psychological evaluations after the abuse and still up to this date • good moral character letters from work or people I worked for For those who waited 4+ years and then got an RFE like this, how did you handle it? Did you mostly rely on affidavits? Did you add extra evidence even if it wasn’t requested? Any advice or personal experiences would really help. Thank you.

just go to a place where you lived with him and ask a manager of building or neighbors who saw you. they didn’t ask for abuse evidences, they want more evidences of your marriage.

Don't include proof of abuse and good moral character. They are asking for proof of bona fide marriage, so resubmit what you have and rewrite your statement focusing on how you met your ex, where, the dating phase, the marriage timeline, and any joint finances.

@Muhammad E. I’ve given them the whole statement, with all the evidence attached. receipts, pictures, the whole timeline with not just words, I’ll see what I can do. thanks

Yeah, that is weird. If you didn't get married while in removal proceedings, you shouldn't be held to a higher standard of proof. I encourage you to find a VAWA non-profit organization in your area to help you respond to the RFE and clear up any misapplication of the law in your case.

@Muhammad E. I guess it has a lot to do with the recent updates. My lawyer said there’s nothing to worry about, since its a real case, they just declared war on fraud and VAWA cases are under more scrutiny. So they’re being more cautious now. But still, I don’t have that much proof:(

well.. did u file by yourself or you hired a lawyer. if you did file by yourself, then I will please advice you to get an experienced vawa attorney. I’m waiting on the day I will receive my approvals etc. then I will write my sorry on how I messsed up by filing my first without a lawyer. also we are only here to share our experience and won’t advice you to take nooo legal advice from anyone here. get yourself together, gather your paper work, hire a lawyer or find you a pro bono. @I’ll be happy s there are things that you can use to prove Bonafide marriage ie your abuser & you married for real and not just for immigration benefits such as 1. Joint Lease ie living together 2. Photos not just wedding day pictures but other pictures with family and friends, pictures taken in parties, pictures in Beach, picture visiting Family members etc 3. Joint Bills 4. Post Office Mails that you received in that same address that you lived with your abuser 5. Joint Health Insurance & Car Insurance, Car Title that was mailed to the address where both of you lived 6. Phone Bills that include both your names 7. Letter from your Landlord or Building Manager confirming your marriage 8. Letter from friend and family ( affidavits). 9. Hospital Bills 10. Child Birth Certificate confirming your both have kid or kids together. This is the most authentic confirmation 11. Joint tax 6.

where you legally married? if you have a marriage license that’s all they need you can go to the court to get a duplicate copy and support your application

@dula strong yes, I’ve already included that joint taxes, financial paperwork, affidavits, bank statements, tickets, trips, bills, pictures. we didn’t have a lease because it was under his brother’s name and we all lived together. will see what else I can add, but I doubt there’s much new I can add :(
