Vawa i765 Based on Adjustment of status was denied
they reasoning was, it was denied because my I’m in removal proceedings and my adjustment of status is pending with the court,
is it some kinda bullshit excuse or whatever I just don’t understand

If one in removal proceeding, the i485 case does not come under USCIS jurisdiction. It comes under the Immigration court to decide on removal and pending i485. If court grants you i485 AOS, you can send that paperwork to uscis, and only then uscis gets involved.

I’m guessing they’re argument is you shouldn’t have filed a adjustment of status to begin with since your removal case is docked in the court. I’m speaking for experience I was not allowed to file for AOS with the my case pending in the court. You’ll probably need to get it dismissed first and then USCIS will have jurisdiction over your AOS.

if your case is in IC you cannot adjust or apply for EAD.AP or AOS through USCIS the court has jurisdiction of your paperwork. if you were applying for EAD while in removal proceedings your i-765 should be category C10 not C9. refile your i-765 with the correct category and you should be good.

if you are in removal proceedings.I 765 process is different. it comes under 42B cancellation of removal proceedings or grant deferred action in this process you only get EAD no adavance parole . what ead you apply ?

it’s legit reason bober, you are in removal processes, therefore until you terminate your case or win, you can’t do business with USCIS
