Vawa derivate 22years old
Hello my daughter was 19 when my I apply for Vawa. now Vawa was approved she is now 22, my lawyer told me that she needs to file an i485 by herself (there might be a way to put her as my derivative they also said.) if she can’t be under my i485 under which category (visa bulletin) does she fall to apply? when I filed the petition I was still married. The Child Status Protection Act (CSPA) does that help here ? thanks in advance.

I have a similar case with you. If you put her name on your vawa during your filing, she is as a detivative, you should have filed her own I485. I do not know if its late for you to do that now but Yes, all your derivatives esp if they may age out should have thier own I485 filing. Goodluck.

I have a similar situation. my VAWA didn’t list him but when I filed my i485 I included him and his birth certificate.

@Q U it’s not too late to file her i485 go ahead and file it, a friend of mine was in the same situation and her daughter had to file her own i485 after her i360 got approved, she was over 21yrs and she’s now a green card holder. so go ahead and send her paperwork in along with a copy of your approval. Have faith and keep trusting God for a good outcome
