I did receive that more than 3 times during the 4 yeas besides EAD cards twice as well.

I will advice to contact congressman for immediate help to ask about the letter if possible a copy of the letter can be sent to them once you give them the permission to represent you.

thanks y’all for your help. which congressman should I contact? yes I did receive rfe month before denial update and I provided request from rfe. my case was filed back December 2020. I had assistance guide who filed the case for and did everything else. we usually got all mails. USCIS status said denial notice was sent out.

I don’t have a professional lawyer on the case but intending to get one now who have experience on vawa case. any suggestions?

Recently, USCIS do not send approval or denial notices anymore. my vawa was approved since august and up until now, i haven’t received any approval notice.I called them to send it and it’s been months now, nothing yet

The denial has to do with the RFE? what was the RFE about? you need to get your hands on that denial letter and appeal ASAP. Whatever deficiency you have needs to addressed.

I did provide réponse to rfe on time and they received it too.

if we know what the RFE was about, we can advice you better on the appeal. Are you sure USCIS received your response?

of course they received the response for rfe. the rfe was about to prove Battery or extreme cruelty and good faith of marriage. I did submit personal and witness affidavits as evidence. my vawa was filed year and half after divorce.

@haada haada My Vawa was approved in July I did receive my approval letter within a space of 3 weeks.

I will suggest you go to best lawyer in your area. search on Google if you are near new york go to dilberlawyer

@M T , to prove Battery , you need Police Report and to prove Extreme Cruelty, one needs Psychological Therapy Report. Do you have any of these two? if no, those two are the primary and licensed source to prove Battery and extreme cruelty respectively . Hire a very good Immigration Attorney to appeal it, otherwise, your EAD has been cancelled already

it's hard 😞, but my advice is for you to refile. this time correct the reasons they gave you for denial. You are not the first and you will not be last

can’t refile because vawa case began after 1.5 year of divorce unfortunately.

In addition, when you file for VAWA after divorce, You must prove that the abuse was the reason for or related to the divorce. did you file for divorce? or your spouse? what was the reason stated in divorce decree?

@survivor p , I filed for the divorce. when filed divorce it’s either consentment or unconsentment by the way. mine was consentment and vawa file just included divorce final decree not the details. thanks

@M T, I’m not sure why people file cases without hiring an attorney. A poorly prepared case can lead to more trouble in the future. You’ll find many devout individuals on this forum. Perhaps they can offer you their prayers.

@MT. I would advise you a great path forward solution. I would advise you to hire a good VAWA lawyer and appeal. in my opinion it is hard to get a positive decision from appeal as what I understood and I am not disappointing you. Therefore. still do the appeal and in the meantime try to find a U.S. citizen and be ready for marriage. You will have one month time. Best of luck

@Shanice blue I got prima facie many times, EAD card twice. case was filed 1.5 year after divorce. most of my proof was affidavits from me and witnesses…

@M T could it be the time frame in which you filed it? even though it’s still within the 2year mark, could it be that they perceived it to be a desperate move?
