VAWA
Hello,
I am currently handling my parents' immigration case since they don’t speak English, and I take care of all their paperwork. Their attorney filed for VAWA, I-765, and I-485. The I-765 was filed under category C31.
I’ve been trying to educate myself on immigration law, and I read that since the attorney submitted the I-485, my parents are eligible for a work permit under C09. I emailed the paralegal and asked if they could file an I-765 under C09, but she replied saying it would cost $1,000 for both cases, plus $200 to file even though my parents already paid the firm $8,000. It sounds ridiculous to pay all that.
Do you have any advice on what I can do? This sounds like it could be the law firm’s mistake.

I filed my initial EAD and all renewals by myself. if you doubt you would be able to do it, look up non profit VAWA organizations in your state, they will be able to do it free of charge.

@Vicki M if you have copies of the i-765 they filed, use that as your guide to file for C09 the only difference would be instead of selecting category C31 choose C09 then attach the i-797C of the i-485’s include a cover letter saying you are applying for category C09 because they have a pending i-485 then send it. There’s nothing much to it you can totally do it yourself. There is no filling fee since it’s based on a pending i-485. Best of luck

don’t pay anything for those forms are very easy. I filed my 360 , 765, 131 by myself. nothing difficult. they don’t do anything even statements you have to write about your abuse. they just fill out those 5 pages. that’s all

@Vicki M please go ahead and file your parent’s EAD under C09 since they’ve already submitted i485. It’s a straight forward form, you don’t need any assistance.

You don’t need to pay again if the attorney made a mistake.
You can contact USCIS directly and ask if your parents can get a C09 work permit since their I-485 is already filed.
You can also file a new I-765 under C09 yourself online. There is no fee when it’s based on a pending I-485.
If the law firm refuses to fix their mistake, you can file a complaint with the state bar or speak to the firm’s manager.
You can also reach out to free legal aid groups or nonprofit immigration clinics for help.
You should not have to pay extra if the attorney filed it wrong.

@Vicki M Vawa EAD is free and has always been free however check or call USCIS to know if Vawa EAD under C09 carries a fee due to the current changes this administration has implemented. Secondly do you have copies of the EAD C31 that was filed on their behalf? IF you do, then just print the I-765 form and refill everything there aside the place where you have C31 which you will replace with C09, and also the preparer part of the form which you have to put your own information. Then go the USCIS site to confirm the other requirements that you need to attach like 2 passport, Cpb I-94, previous copy of EAD if they ever got any etc. After that you check the address you need to send it to and mail it. That’s all.

@Vicki M that's the same exact thing my attorney did with mines and I've been waiting over 2 years now without an EAD so I ended up doing some research and found out how to do it myself because other attorney were telling me $1200 and $1800 which I can't find because I'm not being able to work so I get the forms printed myself and filled them out and submitted it to the correct lock box and the accept it now it's processing it only cost me the fee to mail it off. you can do it yourself trust and believe
