VAWA - REMARRY
My VAWA is pending. I met someone and we have a beautiful family now. We want to get married. Is it possible to File again I-130/I-485 even though my VAWA will be cancelled due to marriage and I have a I-485 pending from my previous marriage? do you know a case like this? thank you.

It is usually not advisable, how long has you i360 been pending?
In my opinion, you can still enjoy your new family while you wait for vawa to be approved. you can get married a day after you get your approval

You can get married, as long as you did no put the application in. You case will process normally. Speaking from experience of someone I know

yes you can get married if you want. but at the interview, prepare yourself to explain to Uscis why you left the first relationship, because if you cannot convince them they will conclude that you left the first person for this new person, and not because you was abused. you can get married if you can find a good lawyer to accompany you... and above all you can no longer apply for vawa regardless of future situations. Some people say they did it and it went well. if you get married and your l-485 is approved after 12 months, you will have a 2 year green card with conditions and it is after 2 years that you can apply for a 10 year card and you have to wait almost another 8 or 12 months to get it. so you will have to wait 4 years to get a 10-year green card without conditions.

@king king so basically itβs better to just wait for the vawa? I was thinking to get married and cancel the vawa petition because marriage filing may be quicker? no?

@shan Luke , try reading the forums about your case on Google to get a clear idea. but you will need a good lawyer to explain to you the advantages and the consequences... to be clear , it will not reduce the timeline if you understood what I explained in my first message. if you get married and you apply for green card, you have to wait 1 year for the interview and if it is approved you will have a 2 year card, so clearly you must be sure that the 5 years which will follow your marriage will give you would be together to have a 10 year permanent card. otherwise you would no longer have any way of getting the card. with vawa it is you yourself who applies for your 10 year green card, with marriage it is your husband or wife who applies for you and you must be sure to be with the person for the next 4 or 5 years to have an unconditional green card

You can be in a relationship while your vawa is processing but can not remarry except you are ready to cancel your vawa application and reapply via your new partner.
