My lawyer advised not to travel with AP if your I-485 is in abeyance. I also got my AP approved but I haven’t been able to use it as my I-485 is in abeyance

@katrona! no, they did not and I doubt they will.

My attorney e-mailed them to see if it was really held on abeyance. It’s been a week and they haven’t replied back to her . She said she doubts they’ll even bother to respond . They only asked her to resend the form G-28 to authorize her to speak on my behalf .

@M H. I read your post. Did you file only i360 VAWA in Oct 2022 and then after requested uscis to hold your pending i485 in abeyance, right?

@VA my attorney filed the 360 and sent the abeyance request at the same time .

From an attorney at youtube, he said, a request to hold i 485 be submitted to service center where ur i485 (marriage based) is pending along with a receipt of i360 vawa petition.

@M H. To exactly know where (nbc or local fo) ur i485 is pending should be the last correspondence/letter you received from. Like, if you got request for medical from FO, then means ur i 485 is at local FO now.

@M H. For ur vawa i360, did you receive a receipt, fingerprints reuse, RFE letter or Prima Facie yet? any updates?

@VA I received a letter that my fingerprints were reused and receipt number . No Prima Facie and No RFE. I think it’s too early for a RFE. Also it’s not everyone who receives PF.

@M H. Receiving a PF is like an initial acceptance of ur vawa claim and evidences, etc. Means you’re pre-qualified. Now after they will look deeper and make evaluation/decision.

@VA and about my 485, the last two mails I got was the fingerprint appointment and 693 deficiency notice back in May 2022. Both form NBC .But when I contact uscis they state it’s at the FO. So idk

@VA not true . There are so many people who got their 360 approved and never received any PF! I personally know 2 people . immigration is a whole different thing. Can’t compare any case to anyone.

@VA my attoney tried to reach out Vermont to confirm it … but no news so far . She used be an attorney for DHS. So I hope she’s doing the right thing

I did from my therapist that see for 2 years and she wrote it . but I didn’t do an evaluation from an immigration psychologist. My attoney said that she thought It wasn’t necessary once I had lot of evidences of bonafide marriage and abuse .

Never physical . But verbal, psychological and financial abuse.

Yes. I use antidepressants and was diagnosed with Anxiety and Depression.

I hope 🤞🏼so. I also submitted lots of affidavit of support from friends and family who knew everything that was going on. I had proof of hotel I stayed when I was out out of the house and also bank transaction where was paid for lock change.

As long as you have a pending I-485 you can travel with advance parole. The only way lawyer advises against it is if you came into the country illegally or have a crminal record. Why would you apply or even be given a document if you are not supposed to use it

or somehow the parole and 485 is canceled while abroad too
