Using the EAD/AP combo card
Hello - My wife just received her EAD/AP combo card today. Our priority date is 12/22/21. We're working through a lawyer for the I-485 and I-130 AOS via marriage-based. I am a US citizen.
She actually came on a 90 day visa waiver (ESTA) and only planned on visiting then going back to Japan. We went on a few domestic vacations during that time and ultimately decided that we did not want to spend further time apart and we got married at the courthouse after 65ish days. We met with a lawyer and ultimately got married and submitted her application all between the 60th and 90th day of her 90 day visa waiver. The priority date of the application is 2 days prior to the end of the visa waiver.
Our lawyer has been clear to us that she is not currently illegally overstaying in the US, as we submitted her application prior to the visa waiver ending. Is that correct?
We will have no problems utilizing the advanced parole card to visit Japan together? Our lawyer advised that we should not stay out of the country for more than 1 month, that we should fly back together when returning to the US, and that we should use the advanced parole benefits only once while waiting for the green card approval. I did not find any information online that limits the use of the advanced parole card in this way, but I guess he is just trying to be as safe as possible? Our plan is to fly to Japan and back together, with our travel totalling 24 days out of the country. This should be fine right?

@beneficial song - it’s ultimately up to you but do take your lawyer’s opinion/suggestion into consideration. or possibly get a 2nd opinion

advance Parole have expiration date and can be one entry or multiple entry. read it carefully as your lawyer must mostly be right.
