use ur advance parole
hello guys I just came back from my trip to my home country Morocco and saw my family for the first time in 4years. i was told by my lawyer to stay in the country and not use the AP and stay in the country, but i did it anyways and i m so glad i did.
i spend 2 weeks in Morocco and I had no issues at all coming back to the US using my AP.
I was asked literally 3 questions by customs: what was the purpose of my trip, for how long, and what is my current address. they were very friendly too
it took 2 minutes for them to check my passport and my AP and was told that I m good to go.
please guys you have nothing to be scared of, the AP was given to us for a reason so if u haven’t seen ur family yet do it. Good luck to everybody ❤️#advanceparole #travel

Does it matter how long you overstayed? Because on the AP it’s said if you’ve overstayed by 180 days that’s a three year banned etc. Let me know
kala beeMar 19, 2024
@Shan Shan I definitely overstayed more than 180days. I honestly had no idea about this info but I had no issues at all

Ok thank you @kala bee

@Shan Shan We don't know the OPs situation but unlawful or overstayed is forgiving if petitioning through a USC.
William UMar 20, 2024
@kala bee The reason your attorney advised you not to the leave the country is due to a possibility of being denied while outside, if that happened CBP would not let you in.
AP is safe to use overall unless you get denied while traveling.

@William u USCIS will usually issue rfe before taking any action on case; and this will allow you to return if you are abroad before the due date
William UMar 20, 2024
@rui Costa Not necessary, if they deemed the applicant does not qualify, there is no need for RFE. Also, you bring a good point regarding RFE, USCIS will send one in most cases if they need extra evidence. The problem is, what if they previously sent one and USCIS accepts but after review denies your application? USCIS can deny your application months after receiving your RFE.
Always know the risk before traveling.

@William u to cut it short; there is risk in traveling with AP. All depend on individual cases
