USCIS Email: “We have taken action on your case” — Nothing Updated in My Account
Standalone i-130 for USC spouse, while in removal proceedings at EOIR, PD Feb 23,2024. Last update was Feb 29,2024: Case Is Being Actively Reviewed. This morning I received an email from USCIS that said, “We have taken an action on your case,” telling me to sign in to view my case status. When I log into mine or the petitioner’s USCIS account, there’s nothing new; no updates or new documents under the case, and the progress status is stuck at 4months for many months now. I spoke with a live agent through Emma, and they told me that my case was assigned to an officer, and that’s the email update. They wouldn’t elaborate. Has anyone else experienced this? How long did it take for your status or new notices to actually show up in your account? Any advice would be super appreciated — thank you!

@Rose R Are you doing an AOS? What this means is that it has been assigned to an officer. This does not mean you will have a decision soon. I had a decision within one week of an officer having my case. I was not interviewed. We did an AOS. You will likely be interviewed as your case will be complex with the removal proceedings. You could be asked to apply for a waiver if there are immigration violations that can be addressed with a waiver.

I don’t have AOS yet. First, I need the standalone I‑130 approved, then my lawyer can ask the court to dismiss my removal case. DHS can either join the motion and agree so I can file my I‑485 with USCIS, or they might want us to do the adjustment of status hearing in front of the judge and DHS. This is the first step on a very long journey, my EOIR case has been going on since 2015 without any movement just status quo. It’s a bit complicated.

it’s a DECISION… check your documents tab in your USCIS account

@Rose R Wow this has been a long process for you. I hope it works out. The 130 should be approved as it is only for establishing a relationship. I hope that your 485 can be processed quickly. Please post updates. Wishing you the best.

Thank you everyone for the kind words. Nothing under documents, we checked both accounts. I am also hoping now that it’s assigned to an officer, will speed up things.

@Rose R Would you like my number? I will post it if would like that and then when you see it I can delete. If I can help at all, research some things for you, I will. I have learned so much about all of this and my husband is a lawyer, not immigration.

Hi @Rose R What happened was that once your case was transferred to another center, they had to call USCIS

Emma agent said the email only meant that the case was assigned to an officer. I don’t know of having the case transferred.
