Urgent travel needs
I am still awaiting correspondence from USCIS, but my greatest fear has happened . My mom passed away while I’m still waiting for my documents.
is there any way for me to expedite my travel documents in order to be with my family in mourning? Has anyone been successful with anything like this?

So sorry for your loss. This is a difficult one. I was in the same situation years ago. I looked at the options and with complete support of my entire family I did not go. I had spoken to an immigration officer who told me even with the travel document, the immigration officer at the port of entry can deny you entry. It was very painful decision. In addition I had spoken to my mom prior to her passing, and she told me donot come down if she passes and I dont have my greencard. I think that made my decion a little easier. But oh lord it was rough.

@Shan S Hi, sorry for the loss of your mom. This must be very hard for you. My dad died in June. I got an emergency travel document. You need to call USCIS and tell them what happened. Don’t live chat. Call the 1 800 number and say info pass. You will get a person. You will need to go in person to your field office and they will interview you and ask what happened. Bring proof!!!! Then they will produce a one time use travel document for you. If you have paid already, then you will not need to again. Get 2 passport photos done at a Walgreens or other place. Please post if you can with an update on how you are doing. My prayers are with you.

@Shan S I was given three months as my mother wanted help selling the house but then she decided not to and I returned in 2 weeks. I also had surgery scheduled here so I came back.
I am from Canada and crossed at a land border. When you come back, they will bring you into secondary. They do this to bring up your information and to document your crossing, write in your passport and to make note of the crossing on the actual form immigration will give you. I was not given a hard time at all. Many of the officers had not seen an emergency 131 so I became a teaching lesson.
Make sure when you leave, I am not trying to scare you, if there is any reason that you could be considered inadmissible to the US. This could include any criminal convictions and prior immigration troubles. Do some research but don’t let it scare you. It is a rather short list of things.

@Shan S I am so sorry for your loss. please reach out to uscis for n emergency travel document. have all the proof necessary and you should be good. my cousins are traveling to and from Jamaica so often you'd think they got a green card. they do not 🤣 they are using the 131and the 1st time coming back the officer said “Welcome home”. if you really want to be there it's worth a try. don't be scared as long as you have no criminal record

@Kingsley B do you think maybe I can get an emergency travel and expedite my 131 and try to travel twice or is that risky? because I would like to go now to deal with funeral arrangements and then go back for the funeral. I don’t know what to do. I guess I’m looking for some advise to make me feel better I guess

@Shan S Hi sorry for the delay. just read your message. The emergency 131 is for one use only. They will likely not process the 131 as an expidite if you have an emergency one. My uncle died the month after my dad and I was refused an expidite. I would advise to get the emergency and spend the time you need while you have it. My normal 131 was approved on day 260 I think.

@Kingsley B thank you for your response. I was thinking to expedite the 131 and then apply for an emergency in hopes to use that one as soon as I get it and then hopefully get the expedited one and use it by February for the actual funeral. ( we take much time to plan)

@Shan S I understand what you are hoping to do. You can try but my immigration lawyer told me if there is an expidite request but then you get an emergency one, they will not expedite the 131. My dad was sick before he died and I was advised not to do it like that. I waited until he was very bad and was going to die soon.
It all does not make sense how immigration works. I am not trying to say you shouldn’t try the way you want to. Please 🙏 post what ends up happening. The worst they can say is no.

Hey guys. I sought after the expedite request but the immigration officer called me to say that they can’t expedite my travel document because my case is in review and on hold so she cannot do anything to it. She advise me to call back some time this week to see if it’s still on hold, otherwise I will have to request the emergency travel document.
I have so many concerns because to do the emergency I will have to do the I-131 form again, pay the $630 again and drive all the way to Montgomery Alabama just to get a limited time in the country. it feels so unfair but I’m praying that maybe it’s in review and they will send the actual travel document soon
