URGENT!! ICE arrests incoming. What to do if ICE is at your door
ICE has plans to start making mass arrests of undocumented immigrants all over the country primarily focusing on Sanctuary cities and states...
If ICE show up at your house DO NOT OPEN THE DOOR, opening the door might be seen as you consenting for their entry.
sometimes ICE agents will pretend to be local police... for example they might pretend they’re investigating a separate matter and want to talk to you about it... they might say they’re looking for a friend, relative or roommate do not let them fool you... ask what agency they’re from, and if they say Immigration and Cusroms enforcement (ICE) DO NOT OPEN THE DOOR unless they a warrant SIGNED BY A JUDGE... they usually don’t have this, they might show you something that looks like a warrant for example Warrent for Arrest of Alien, however; these aren’t valid unless it’s signed by a judge. don’t open the door unless they have a Judicial warrent that is signed by a judge.
If ICE shows up at your door, remain calm. Politely ask them to show a warrent and ID. Ask them to slip these documents under the door or hold them up to the peep-hole. without a warrent signed by a judge, ICE is not allowed to enter your home without permission. ICE usually won’t have a warrent, but they may lie and say they do or they might show you something that looks official. look carefully and take pictures of whatever they show you. if they refuse to show any of these documents then ask them for their card and contact information.
Do not show the agents anything or say anything other than:
“I do not consent for you to enter my home.”
“I do not want to talk to you without a lawyer present.”
“Please leave.”
ICE may not listen to you and enter by force, however; saying these things may help you in court. If you get arrested, you’re entitled to a court hearing before you get deported. ICE may trick you into waiving your rights. do not say anything, show any documents you have or consent to a search. before speaking to a lawyer. Tell them your excerising your right to remain silent and would like to speak to a lawyer.
don’t produce any fake or forged documents and do not lie to the officers... this will cause you more problems later on.
DO NOT SIGN ANYTHING WITHOUT YOUR LAWYER PRESENT, you have a right to an Interpreter if you do not understand the papers you’ve been given.
ICE is not required to provide you with a lawyer but they’ll provide you with a list of free or low cost alternatives in your area.
Keep in mind when you’re on the phone in an ICE detention facility, they’re allowed to listen to your calls unless you’re speaking to a lawyer.
