Update on the EB-4 Backlog
Firstly, the latest Visa Bulletin for June 2023 was published today, maintaining the cut-off date of September 1, 2018.
Secondly, in response to the ongoing border crisis, the Department of Homeland Security (DHS) has announced plans to establish a family parole program specifically for applicants from Colombia, Guatemala, El Salvador, and Honduras. Under this program, individuals with approved I-130 petitions (whether new applications will be accepted is still uncertain) may be granted parole to enter the United States and be issued work visas.
If this initiative is implemented, these countries may experience a significant increase in visa applications, potentially reaching the 7% per country cap. Consequently, they would be considered "oversubscribed" in the family-based preferences (Guatemala, Honduras, and El Salvador are already oversubscribed in the employment-based preference, courtesy of the Special Immigrant Juveniles backlog). Given oversubscription in both employment and family-based preferences, a separate column may be created to accommodate them, along with a distinct cut-off date. Such a development could effectively alleviate the backlog in the EB-4 category.

This is good news, no?

We hope so too.

Potentially good news for non-SIJS applicants. Still, I'm cautiously optimistic. This is the only possibility that could provide a significant remedy to the situation, aside from congressional intervention.

@Rezaul Rana You are not affected by the retrogression. Here are your potential choices: 1. Send an expedite request. 2. Raise a Service Request 3. File a mandamus lawsuit. Consult with a competent attorney for guidance.

Yes, both of your dates are in the backlog. They are currently adjudicating cases with an I-360 that was submitted before 1 SEP 2018.

Hey, N G, do you have latest news on the backlog?

Let's urge USCIS to resume releasing the "EB 485 pending report" (btw they released for 10 years but stopped in 2018), which can tell us the number of people waiting in line before our PD and estimate the wait time. I filed FOIA request and commented on the USCIS data page (https://www.uscis.gov/tools/reports-and-studies/immigration-and-citizenship-data) many times to ask for this. The more people ask for this, the more likely USCIS will take this seriously and release it.
