Unsolicited documents
Hello. Is it advisable to (or can one) submit unsolicited documents after having responded to an RFE? This additional evidence just came in. If yes, please how do I go about it? I've searched online but didn't see much solution. Thanks

yes. if you believe it can contribute significantly to your case. State it in the introductory part of you RFE response the new information you are submitting as part of your response and why. Be precise and clear as possible as you can.

@Manifest Law confusing and conflicting advise. I’ve seen a similar question on Reddit and a manifest lawyer advised the person should upload. this is worrying. should you all be on the same page

@S S This is not a legal advice and I’d use my own experience to answer your question. I was in your situation. I had a rfe for my i485 and submitted it 3days afterwards. but I felt I needed to add a n extra document and as well clarify or correct a clerical mistake. what did I do? I went ahead and submitted the extra document ( one month after I submitted the rfe) then two days later i submitted a cover letter clarifying the mistake I later discovered. I got approved and have my green card now. btw my case was eb2niw related. if you need to clarify or submit an extra document you can frame your judgement based my experience. if you decide to submit an unsolicited evidence do so with a clear and consise cover letter. Don’t over explain. I hope this helps

Yes, you can submit additional evidence after responding to an RFE. The safest way to do it is through your USCIS online account directly under your case. When you upload it, you may want to include a brief note stating that this is supplemental evidence following your RFE response. Just keep in mind that USCIS can still decide your case based on what was already submitted, so don't rely on supplemental evidence to fix something significant that was missing from your original RFE response. But if it genuinely strengthens your case, it's worth submitting.
