unemployment benefits while waiting for vawa decision
so I applied for vawa, I currently lost my job due to mass layoff and I’m wondering if applying for unemployment will affect my vawa application .

@tobi O It will not affect your application, you can apply, Here’s what USCIS website says: Noncitizens may be concerned about applying for and receiving unemployment benefits and potentially subjecting themselves to the "public charge" ground of inadmissibility in light of the Department of Homeland Security's (DHS) new and more restrictive analysis. A "public charge is someone who likely to receive public benefits in the future. If a noncitizen is found to be inadmissible as a public charge, he or she is not eligible to become a lawful permanent resident and receive a "green card." Unemployment benefits are not means tested public benefits and should not negatively affect a noncitizen's immigration status or result in a public charge bar to residency or other nonimmigrant status in the future. @tobi O it’s seems will not affect . when is vawa filed and any rfe or prima facia ?? Did you receive any severance package from your company, like money for layoffs ??

@tobi O DO NOT !!! It has a way of negative impact on your case in that the Country does not require someone who will be a liability but people who are self sufficient and self reliance when given green cards ! So, please think twice before requesting for any favors even when you are entitled.

Just to clarify something, unemployment is money you worked for, not everyone qualify for it whether you are a citizen or not. They look at your record and see the amount of work you’ve done in the past and approve/disapprove you based on that. If it’s an involuntary situation and you have worked enough hours in the past, you qualify. It is your right, not a favor from the government as many people presume.

thanks everyone i did a lot of research too and it says you’re except especially when you’ve worked in the past and have more than enough in reserve . but as @lala said this people has a way of doing stuff sometimes thanks everyone tho
