I'm in June 2021 filers TSC, now out of work because my 180 day expired. Had 3 expedites denied even though our household has no income now.

my lawyer tell us that they can file a suit against USCIS now, they currently get EADs within 7 days (around 5k)

We can just hope they move faster with their current load. @Ben Galore: I’ve heard some people have filed suit against USCIS. But what do you mean by 7 days? @kizzy: Such as an unpleasant situation. Are you planning to expedite again? I know someone who requested expedited processing many times, way more than you did, before she got it approved.

the lawyers got the results as fast as 7 days after filter a mandamus case against USCIS. In particular for I485 with fingerprints taken a while ago. currently reading an article where lawyers ask 4000 + 1000 per family member am22

Ben, they aren’t. I am in the SRC2190155 series and they barely scratched it. I follow a chinese group on telegram that post daily updates. if you have $5k then good for you, I and a lot of people don’t.

I have no idea if they can guarantee anything, my understanding is that more than 180 days for an EAD is always considered as anormal by the court

@Ben Galore: Of course it is abnormal particularly when they only extend your authorization for only 180 days. I just don’t get why don’t they try to remediate the situation by simply extend the length of the extension to accommodate the situation. It’s like they don’t care at all about people loosing their job, otherwise they would have at least try doing something.

yes , I'm still amazed they deny expedite requests for families without any income, that blows my mind because what is it if not an extreme hardship???

Ben I understand, I know people that are 12 months without income, going through their savings, borrowing money and driving uber, and they were high paid people while working on EAD. Just because of the utter incompetence of USCIS. The tricky part is that the lawyers cannot guarantee anything. So you can pay &5k but no guarantee that it will help adjudicate the application faster. Just google siskind’s attemp to sur the government for the delays of ead based on pending AOS, and you will see that nothing happened. They will milk the money, go to court and when they fail they will say “oh well we tried”. Personally, even If I had that money I would never give it to the lawyers for mandamus. It’s just principe and I’ve seen how many other attempts failed and how they conducted themselves after.

all the plaintiffs but 2 got their EAD on Siskind class action. but I agree with this money should not exist

I checked on thar story in Nov last year, at that time they were complaining that they lost to the govt and that they require additional fees for a case to case basis. Good for the that they won. But I don’t have that money. By all means, if anyone can, go for it.

it was 1000 if I'm correct, so if the classification as class is granted it would be cheaper than premium processing. they did not win USCIS is trying to moot the case by granting all the EADs but if class action granted they can add plaintiffs whenever they want. For the two remaining unlucky USCIS says "it's only been 9.5 months since they requested" how cynical ...

@ Sassy J I am so discouraged that they think no income and insurance is not hardship, we can't even drive uber because our drivers licenses are also expired with the EAD. I will try again soon and hope to God that an Officer with empathy gets it....

@ Ben Galore, I know I was just drawing reference to our situation of uncertainty, my husband was laid off at the end of 2020, I was the only income, the pressure is real, I am trying to stay positive and not let our young kids see us down. I wish everyone on here luck, I know you all understand how we feel.
