Travelling with Advance Parole
Hi guys, I was wondering if anyone could help/advise on my situation. I applied for vawa back in 2023. So I have a pending vawa and green card application. I have a combo card. I also recently just received my prima facie which is valid for a year. But I tried expedite my case back a few months ago and it was denied. I really would like to travel however I am a bit scared… I previously overstayed by 3.5 years and the other reason is because my expedite request was denied. The latest activity on my case says: Expedite Request Denied. So what I’m trying to say is I’m scared what CBP will say or what they will do because it says DENIED. What do you guys think? Any suggestions/advice? Thank you all in advance.

First of all, my advice would be DO NOT TRAVEL at this time for obvious reason except for serious emergency. Secondly, if you must travel, make sure you tidy up-make sure you don’t anything that can raise any suspicion on your phone or luggage when you’re coming back and you should be ready for some interrogation (maybe or maybe not) Thirdly, have a backup plan in case the unexpected happens.

I know someone that was denied entry 2 weeks ago using AP . He was questioned about things found on his phone and he was eventually deported.

apu, I told you to contact me personally if your remember. Anyway, assuming you came on B1/F1, you should be fine but at the same time, once you're out of status, it's already flagged in the system. Usually, people who came on F1, they're told leave the country withing 14 days after the SEVIS termination. On the contrary, after the submission of Vawa, you remain in this country under 'authorized stay' due to being a victim' of abuse. So, it depends on the timeline of whether your submitted vawa while you're not out of status. Also, it's subjective and thus under the discretion of immigration officers to whom they will let in upon returning. If an office finds out you were out of visa status while you were in the country, then that can be an issue. But at the same time, they may not even look that deep if they see you came here legally and didn't commit any crime. there are people who came back with AP but also people who got detained with GC. So, it's all subjective and thus speculative.

@MD ABDULLAH AL MAMUN Bhai - I came here with a ESTA from UK. I am a British citizen. I overstayed my esta by 3.5 years. I travelled under Biden Administration last year. I had no problems. But with this new administration I’m just really scared. Umrah te jaitam plan korsilam. Amar onek iccha Allah Bari jaitam… like I really need it. I want to go and feel at peace and ease. But I am too scared. Dua korben amar jonno bhai….

I’m now preparing for my upcoming trips to Brazil and China 🇨🇳 next month. All of my travels have been on Advance Parole, and the experience has been consistently smooth. At primary inspection, I’m usually asked just a few simple questions like where I traveled, how long I stayed, and whether I’m bringing anything back. Then I’m directed to secondary, which has always gone quickly and without issues. I know many people are nervous about traveling on Advance Parole, but in my case, it’s been straightforward every single time. Just stay prepared and confident.

@Jasmine Rahman Yes and I have used JFK 3 Times, Miami, Fort Lauderdale, Las Vegas where I reside, Los Angeles, Atlanta, San Francisco . I wouldn’t recommend Chicago, Newark and Boston Airport

If you’re ever in Vegas, I’ll pick you up from the airport myself — no job applications, just hospitality. 😎 I don’t comment to scare people — I give advice based on real experience.
