Traveling from NYC to Florida
hey my lawyer suggested I should not travel to Florida while my Vawa case is pending. The ICE can still detain me and deport me because only filing doesn’t mean i am safe from getting detained. is it true? I can’t travel domestically also ?

@a k Just try and see what will happen dear🙂. You know if caught then will be chained both legs and hands and deported. My dear! please obey your lawyer and don’t take risk. if you had EAD and have filed I-485 pending then you should be fine provided if you not illegally crossed the border.

my ead is pending and i485 is also pending. and no i was never illegal or crossed the border

@a k Ok. Please have a copy of your I-485 receipt with you always.. Should have proactively renewed your EAD much ahead. I believe your EAD should be valid upto 540 days from its expiry date and so have the copy of the exisiting EAD copy where it states the EAD validity extension upto 540 days. I always carry the same because we never know anywhere these ICE guys are looking forward to trap people. We cannot be free unless we get the GC in hand.. Always stay safe

@Tom Hank’s Hans I don’t get it i have my biometrics updated on i-485 you mean that everyone you has a i-485 pending can be deported by ice?

well I saw a lot lawyers saying avoid airport if u have a case pending. wait until April (after 3 months to travel) if you go have your receipt with you.
I think if you have your receipt with you they nothing that they can do.

@a k I meant if you have filed I-485 and have a receipt with you then you are safe. Your status will be AOS pending or I-485 pending or waiting for the green card. So you are good.

I don’t understand why these lawyers keep scaring people. I just traveled from Seattle to Washington DC. There was no issue. if you don’t have any criminal records and you did not enter the country illegally , I don’t think you should have a issue.
I do not see why traveling domestic should be an issue.

@o I don’t get it. i talked to one another lawyer and it was the same thing. I didn’t know that ice can detain somebody with pending i-485

If you've a pending case (i130/360+i485), you're in a period of authorized stay (lawfully present) in the USA. keep copies of those and EAD card, if you have one, you are all set and safe to travel in/outside US as long as you have a "clean record".
***Those are at risk who entered illegally and/or have a "bad record" here regardless of pending petiton/i485 application.***
